Allgemeine Geschäftsbedingungen
General Terms and Conditions of Mobility Hub Parkservice Austria GmbH for the online booking of parking services
Last updated: 14.05.2024
The following General Terms and Conditions ("GTC") apply exclusively in the version valid at the time of the respective booking to the sale of parking services via online sales channels (hereinafter: "Online Shop") of Mobility Hub Parkservice Austria GmbH, legally represented by its Managing Director Volker Brockmeyer, Krottenseestraße 45, 4810 Gmunden, Tel.: +43 72 011 69 48, info@mh-parkservice.at, hereinafter referred to as the "Operator".
The Operator recommends that customers print out or save these GTC and other legal and contractual texts to document the respective transaction.
The Operator does not store the full text of the contract for each transaction. If the customer wishes to print the contract text for their order, they must use their browser's print function during the final step of the ordering process. If the customer wishes to save the contract text, they must save the copy of these GTC provided during the ordering process.
1. Scope, definitions, and contact information:
1.1 These GTC apply to all contracts concluded between the customer and the Operator for the parking services presented in this Online Shop. For the purposes of these GTC, parking services are defined as all products and services that can be booked from the Operator via the Online Shop.
- 1.3.1 A consumer within the meaning of Section 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
- 1.3.2 An entrepreneur within the meaning of Section 14 of the German Civil Code (BGB) is any natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.
1.4 You can contact the Operator by mail at the registered address of Mobility Hub Parkservice Austria GmbH, legally represented by its Managing Director Volker Brockmeyer, Krottenseestraße 45, 4810 Gmunden, Tel.: +43 72 011 69 48, info@mh-parkservice.at.
2. Subject matter of the contract / Booking options:
Customers can book and pay for the following parking services via the Online Shop:
- Online payment for parking: In accordance with these GTC, users of the parking facility specified in the product description are given the option to pay the fee due for the parking process—as a service provided without the use of remote communication—online before exiting the parking area ("Realtime Payment"), as an alternative to paying at a parking machine on-site.
- Digital post-payment option: In accordance with these GTC, users of the parking facility specified in the product description are given the option to pay the fee due for a completed parking process—as a service provided without the use of remote communication—online even after exiting the parking area, if the user was unable to or inadvertently failed to pay the fee due at the time of the parking process ("Postpayment"). By selecting the parking area used and entering their vehicle license plate number into the input mask provided by the Operator, the customer can check whether they are eligible for post-payment. Post-payment is available for up to 24 hours after exiting the parking area, unless otherwise specified in the product description.
- Purchase of fixed-price tickets: In accordance with these GTC, users of the parking facility specified in the product description are given the option to purchase fixed-price tickets for a pre-determined parking duration (e.g., daily tickets or long-term parking tickets (weekly, monthly, and annual passes)) for the parking facility mentioned in the product description.
- Purchase of parking credit: Users with a user account created with the Operator can purchase credit for the parking facilities specified in the product description or store a credit card, similar payment card, bank account for direct debits, or another payment method accepted by the Operator ("Payment Method"). The parking fee due for parking processes, based on the rates valid at the time for the respective parking area—subject to any special rates for which the customer is eligible (cost-neutral or discounted use for specific user groups ("Eligible Parking"))—will be deducted from the available parking credit or charged via the stored payment method ("Pay-by-use").
Not all parking services are available for all parking areas. The respective product description in the Online Shop is decisive. The terms of use for the respective parking area, as posted on-site at the time, apply to the use of that area.
The contractual partner for the use of the parking area specified in the product description is Mobility Hub Parkservice Austria GmbH. In addition to these GTC, the General Parking Terms and Conditions of the parking area specified in the product description also apply, which can be accessed via the link provided in the product description.
3. Provisions regarding contract conclusion:
3.1 The parking services presented by the Operator in the Online Shop do not constitute legally binding offers to conclude a contract, but rather serve as an invitation to the customer to submit a binding contractual offer (so-called invitatio ad offerendum).
3.2 The legally binding submission of the purchase offer by the customer for the selected parking service is made by clicking the "Pay" button. The customer is bound to this purchase offer for fourteen days from the time of booking. The Operator is entitled to reject the customer's purchase offer until it has been accepted.
3.3 The contract is only concluded once the operator sends the declaration of acceptance.
3.4 Immediately after the customer completes the booking, the operator will send a booking confirmation (payment receipt) to the email address provided by the customer in the online shop or during the payment process. This booking confirmation serves both to document the booking and fulfill the operator's legal obligations under Section 312i (1) sentence 1 no. 3 of the German Civil Code (BGB), as well as to confirm the operator's acceptance of the contract.
4. Detailed description of the booking process:
In accordance with Section 312i (1) sentence 1 no. 2 BGB in conjunction with Art. 246c no. 1 EGBGB, the operator must provide the customer with the individual technical steps leading to the conclusion of the contract.
4.1 Realtime Payment and Post Payment
4.1.1 Initiating the booking processIf a booking form is available on the website, the process begins by filling out and submitting that form. The customer must enter their vehicle license plate number in the designated field. The available parking services for that area will then be displayed. The customer can select the desired parking service. By clicking "Buy" (for fixed-price tickets) or "Pay now" (for other parking services), the customer is taken to an overview page where they can review their selected parking service, the validity period, the license plate number, and the total price including all additional costs. To finalize the booking, the customer must click "Pay now".
4.1.2 Selecting payment method and completing the bookingThe customer is then redirected to the respective payment service provider's portal. There, they will see another overview of the selected parking services, the pending booking, and key contract information, especially the total price. Finally, the customer can select their preferred payment method. By clicking the "Pay" button, the customer completes the booking process, thereby submitting their legally binding offer to enter into a contract.
4.2 Online Shop
4.2.1 Registration and verification for authorized parkingFirst, the customer is asked to enter their details or create a new customer account if they are a first-time user. If already registered, the customer can enter their details and click "Login" to access their account. To create a new account, the customer must provide their full name, email address, and a password of their choice. If the customer belongs to a group eligible for authorized parking (e.g., as an employee of one of the operator's clients), creating a customer account is mandatory to access special rates. Access to these special rates is only possible once confirmed or activated by the respective client of the operator and remains valid only for the duration of the customer's eligibility. By creating an account, the customer confirms that they will use the parking authorization only personally, with the registered license plate, and only for the duration of their eligibility (e.g., for the duration of their employment, subject to the earlier termination of the contract between the operator and the client). The operator reserves the right to request proof of eligibility for special rates. If the customer fails to provide such proof, they are not entitled to use the authorized parking services. Once the customer clicks "Register," their account data is saved, and they can proceed with the ordering process as described in section 4.2.2.
4.2.2 Initiating the booking process for fixed-price ticketsIf a booking form is available on the website, the process begins by filling out and submitting that form. The customer must select the desired parking area. The available parking services for that area will then be displayed. The customer can select the desired service by clicking "Select ticket" and, if applicable, make further selections (e.g., specifying a usage period or date for fixed-price tickets, selecting the parking area, or entering a license plate number) and add the service to the shopping cart by clicking "Add to cart." The customer can then choose to continue shopping or proceed directly to the cart and checkout. Upon reaching the cart, the customer will see their selected items, including descriptions, quantities, and the total price, including all additional costs and separately listed shipping fees. To finalize the booking, the customer must acknowledge and accept the Terms and Conditions and the Privacy Policy, then click "Buy ticket."
4.2.3 Initiating the booking process for Pay-per-UseIf a booking form is available on the website, the process begins by filling out and submitting that form. The customer must select the desired parking area. The available parking services for that area will then be displayed. The customer can select the "Pay-per-Use" service and, if applicable, make further selections (e.g., specifying a usage period, selecting the parking area, or entering a license plate number) and add the service to the shopping cart by clicking "Add to cart." The customer can then choose to continue shopping or proceed directly to the cart and checkout. Upon reaching the cart, the customer will see their selected items, including descriptions, the usage period, and the total price, including all additional costs. To finalize the booking, the customer must acknowledge and accept the Terms and Conditions and the Privacy Policy, then click "Buy ticket."
4.2.4 Selecting payment method and completing the bookingFinally, the customer is redirected to the respective payment service provider's portal. Here, the customer receives an overview of the selected parking services, the pending booking, and key contract information, particularly the total price and the selected parking service. By clicking the "Pay" button, the customer completes the booking process, thereby submitting their legally binding offer to enter into a contract.
5. Right of withdrawal
Existence of the statutory right of withdrawal for consumersIf the customer is a consumer as defined by Section 13 BGB ("any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession"), they have a statutory right of withdrawal. Employees and civil servants are also considered consumers under Section 13 BGB.
There is no right of withdrawal for the following services:
- Realtime-Payment (incl. fixed-price tickets where the start date has already passed at the time of booking)
- Postpayment
- Pay-per-Use
The underlying main service for these parking options has already been provided without the use of distance communication. The operator merely offers the option to pay the fee owed for the service online before exiting the parking area. The right of withdrawal does not apply to distance contracts for the provision of services in the areas of accommodation for purposes other than residential, or for services related to leisure activities, if the contract provides for a specific date or period for the provision of the service.
Provisions applicable to the right of withdrawal (cancellation policy):
Cancellation policy
Right of withdrawal You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date the contract is concluded. To exercise your right of withdrawal, you must inform us (Mobility Hub Parkservice Austria GmbH, Krottenseestraße 45, 4810 Gmunden, email: widerruf@mh-parkservice.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of cancellationIf you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery we offer). This refund will be made immediately and no later than fourteen days from the day we receive notice of your cancellation. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise; you will not be charged any fees for this refund. If you requested that the service begin during the cancellation period, you must pay us a reasonable amount corresponding to the proportion of services already provided up to the time you notify us of your cancellation, compared to the total scope of services provided for in the contract.
End of cancellation policy
You may use the following form to declare your cancellation, though it is not mandatory:
Model cancellation form(If you wish to cancel the contract, please fill out this form and send it back to us.) Mobility Hub Parkservice Austria GmbH, Krottenseestraße 45, 4810 Gmunden, Email: widerruf@mh-parkservice.com– I/we (*) hereby cancel the contract concluded by me/us (*) for the purchase of the following goods (*)/the provision of the following service (*)– Ordered on (*)/received on (*)– Name of consumer(s)– Address of consumer(s)– Signature of consumer(s) (only if submitted on paper)– Date
(*) Delete as applicable.
6. Customer obligations:
The customer confirms that they are of legal age and will provide truthful information required for the execution of the contract, and will immediately notify us of any changes relevant to the contractual relationship, in particular any change of address or name.
Booking processing and communication generally take place via email as part of an automated booking process. The customer must therefore provide a valid email address for booking purposes where emails sent by the operator can be received. In particular, it is the customer's responsibility to ensure that the receipt of emails sent by the operator is not hindered by the use of a spam filter or similar technical devices.
The customer will not share their customer account, password, or other access credentials with third parties, and in particular will not share them with anyone else.
The customer is aware that they must provide the correct license plate number for their vehicle during the booking process and that the booked long-term parking ticket is only valid for this specific vehicle and cannot be transferred to other vehicles, including other vehicles owned by the customer.
7. Prices, payment terms, and refunds:
The prices stated in the operator's online shop are total prices (final prices), meaning they include all price components, including the statutory German VAT. Unless otherwise agreed, the customer is obligated to pay the full purchase price upon conclusion of the contract.
Bookings for fixed-price tickets or credit for pay-as-you-go, as well as payments for real-time and post-payment, are processed by the operator using the following payment methods: credit card, Sofortüberweisung, Giropay, Google Pay, Apple Pay, Link
Pay-as-you-go credit is deducted in advance after booking. If the credit chosen by the customer is used up, an automatic top-up in the amount of the previously selected credit will occur, unless the customer objects to the top-up in good time before the existing credit is exhausted. Unused credit will not be refunded.
When using pay-as-you-go, the parking fee owed for the respective parking session is based on the rates valid for the parking area at that time (in accordance with the signage present at the parking area at the time of use), unless the customer is entitled to cost-neutral or discounted use via authorized parking. The parking fee becomes due upon completion of the respective parking session and is collected via the payment method stored by the customer or deducted from the customer's existing credit. The customer hereby declares their consent to this deduction or offsetting.
8. Delivery terms:
As soon as the invoice amount has been credited to the operator, the customer will receive a confirmation via email to the address provided in the online shop or stored in their customer data with the operator after a successful booking. Parking services cannot be sent by post.
9. Liability:
The operator is liable to you in all cases of contractual and non-contractual liability for intent and gross negligence in accordance with statutory provisions for damages or reimbursement of wasted expenditure.
In other cases, the operator is only liable – unless otherwise stipulated in section 8.3 – for the breach of a contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on whose compliance you as a customer may regularly rely (so-called cardinal obligation), limited to the compensation of foreseeable and typical damage. This limitation of liability also applies to our vicarious agents. In all other cases, liability is excluded, subject to the provision in paragraph 3.
The operator's liability for damages resulting from injury to life, body, or health, as well as under the Product Liability Act (PHG), remains unaffected by the above limitations and exclusions of liability.
10. Copyright:
The operator holds the copyright to the images, films, and text on this website or has obtained the rights to use images, films, and text belonging to third parties. Any use of these materials by third parties requires prior approval from the operator.
11. Jurisdiction, Applicable Law, and Contract Language:
Contracts governed by these terms and conditions are subject exclusively to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer with a habitual residence abroad, mandatory provisions of that country remain unaffected. The contract language is German.
If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is the operator's registered office.
12. Code of Conduct:
The operator has not subscribed to any specific codes of conduct as defined in Art. 246c No. 5 of the Introductory Act to the German Civil Code (EGBGB).

- Digital late payment option: Users of the parking facility specified in the product description are granted the option, in accordance with these GTC, to pay online the fee owed for an already completed parking process, as a service rendered without the use of means of distance communication, even for a certain time after exiting the parking area, if the user was unable or inadvertently failed to pay the fee owed for the parking process at the time of the parking process ("Postpayment"). The contracting party for the use of the parking area specified in the product description is Mobility Hub Parkservice Austria GmbH. In addition to these GTC, the General Parking Conditions of the parking area specified in the product description, accessible via the link provided in the product description, also apply.
3. Regulations Regarding the Conclusion of the Contract:
3.1 The parking services presented by the Operator in the Online Shop do not constitute legally binding offers to conclude a contract, but serve as an invitation to the customer to submit a binding contract offer (so-called invitatio ad offerendum / invitation to treat).
3.2 The legally binding submission of the purchase offer by the customer is carried out for the respectively selected parking service by clicking the button "Pay". The customer is bound to this purchase offer for fourteen days from the submission of the booking. The Operator is entitled to reject the customer's purchase offer until acceptance.
3.3 The contract is only concluded upon receipt of the declaration of acceptance by the Operator.
3.4 Immediately upon receipt of the booking by the customer, the Operator will send a booking confirmation (payment receipt) to the email address provided by the customer for this purpose in the Online Shop or during payment. 4. Detailed Description of the Booking Process:
Pursuant to Section 312i (1) Sentence 1 No. 2 BGB in conjunction with Article 246c No. 1 EGBGB (Introductory Act to the Civil Code), the Operator must provide the customer with the individual technical steps that lead to the conclusion of the contract.

If the customer belongs to a group of persons eligible for Authorized Parking (e.g., as an employee of a client of the Operator), the creation of a customer account is mandatory for the utilization of special tariffs for Authorized Parking. The utilization of special tariffs for Authorized Parking is only possible upon confirmation or activation by the respective client of the Operator and for the duration of the qualification for Authorized Parking granted to the customer by the respective client of the Operator. By creating a customer account, the customer qualified for Authorized Parking guarantees to use the parking authorization granted to them only personally with the license plate number deposited for this purpose and only for the duration of the qualification for Authorized Parking granted by the client of the Operator (e.g., duration of employment, subject to the earlier termination of the contract existing between the Operator and the client). The Operator is entitled to demand appropriate proof from the customer for the utilization of special tariffs for Authorized Parking. The customer can now decide whether they wish to continue shopping or go directly to the shopping cart and checkout. If they finally go to the shopping cart after completing their shopping, they will again find their selected items there with the item description, the product quantity, and the price including all ancillary costs and separate identification of shipping costs. If they wish to book the selected parking service(s) now, they must, after having taken note of and confirmed the GTC and the privacy policy, click again on “Buy ticket”.

The customer can now decide whether they wish to continue shopping or go directly to the shopping cart and checkout. 5. Right of Withdrawal:
Statutory right of withdrawal for consumersIf you are a consumer as defined by Section 13 of the German Civil Code (BGB)—meaning a natural person entering into a transaction for purposes outside your trade, business, or profession—you have a statutory right of withdrawal. This also applies to employees and civil servants.
There is no right of withdrawal for the following services:
- Real-time payment (including fixed-price tickets where the start time has already passed at the time of booking)
- Post-payment
- Pay-per-use
The primary service for each of these parking options is provided without the use of distance communication. We simply offer the convenience of paying your parking fee online before you leave the facility. The right of withdrawal does not apply to distance contracts for accommodation services (other than for residential purposes) or for leisure activities if the contract specifies a particular date or period for performance.
Terms regarding your right of withdrawal:
Withdrawal Policy
Right of withdrawalYou have the right to withdraw from this contract within fourteen days without providing a reason. The withdrawal period is fourteen days from the date the contract is concluded. To exercise your right, please notify us (Mobility Hub Parkservice Austria GmbH, Krottenseestraße 45, 4810 Gmunden, email: widerruf@mh-parkservice.com) of your decision via an unequivocal statement, such as a letter sent by post or an email. You may use the attached model withdrawal form, though it is not required. To meet the deadline, it is sufficient to send your notification before the fourteen-day period expires.
Effects of withdrawalIf you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a more expensive delivery method than our standard option), without undue delay and no later than fourteen days from the day we receive your notice of withdrawal. We will use the same payment method you used for the original transaction unless otherwise expressly agreed; you will not be charged any fees for this refund. If you requested that services begin during the withdrawal period, you must pay us an amount proportional to the services provided up to the time you notified us of your withdrawal, relative to the full scope of the contract.
End of withdrawal policy
You may use the following form to withdraw, though it is not mandatory:

Booking confirmations and general communication are handled via email through our automated system. You must provide a valid email address that can receive our messages. It is your responsibility to ensure that your email settings, such as spam filters, do not block communications from us.
You agree not to share your customer account, password, or other access credentials with any third parties.
Please ensure you enter the correct license plate number during the booking process. Your continuous parking ticket is valid only for that specific vehicle and cannot be transferred to other vehicles, even if they belong to you.
7. Prices, Payment Terms, and Refunds:
Prices in our online shop are final and include all components, including the statutory German value-added tax (VAT). Unless otherwise agreed, payment is due in full upon conclusion of the contract.
Fixed-price tickets, Pay-by-use credit, and Realtime or Postpayment transactions are processed by the Operator using the following payment methods: credit card, Sofort, Giropay, Google Pay, Apple Pay, and Link.
Pay-by-use credit is charged in advance upon booking. Once your credit is depleted, it will automatically top up by the original amount, unless you opt out before the balance runs out. Unused credit is non-refundable.
When using Pay-by-use, parking fees are based on the rates posted at the parking facility at the time of use, unless you are eligible for free or discounted parking. Fees are due immediately after your parking session ends and will be charged to your saved payment method or deducted from your credit balance. By using the service, you authorize these charges or deductions.
8. Delivery Terms:

9. Liability:
The Operator is liable for damages or wasted expenses in cases of intent or gross negligence, in accordance with statutory requirements.
In other cases, the Operator’s liability—unless otherwise specified in Section 9.3—is limited to the breach of essential contractual obligations (cardinal obligations) and is restricted to foreseeable, typical damages. This limitation also applies to our agents. All other liability is excluded, subject to the provisions in paragraph 3.
The Operator’s liability for injury to life, body, or health, as well as under the Product Liability Act, remains unaffected by these limitations.
10. Copyrights:
The Operator owns the rights to the images, videos, and text on this website, or holds the rights to use third-party content. Any use of this material by third parties requires prior permission from the Operator.
11. Jurisdiction, Applicable Law, and Contract Language:
These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer residing abroad, mandatory local laws still apply. The contract language is German.
If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for any disputes arising from this contract is the Operator’s registered office.
12. Code of Conduct:
The Operator is not subject to any specific codes of conduct as defined by Article 246c No. 5 EGBGB.
