General Terms and Conditions of Mobility Hub Parkservice Switzerland GmbH for the online booking of parking services

Last updated: 14.05.2024

The following General Terms and Conditions ("GTC") apply exclusively in the version valid at the time of the respective booking to the sale of parking services via online sales channels (hereinafter: "Online Shop") of Mobility Hub Parkservice Switzerland GmbH, legally represented by its Managing Directors Volker Brockmeyer, c/o BDO AG Obere Spichermatt 12 6370 Stans, Tel.: +41 21 561 36 30, info@mh-parkservice.ch, hereinafter referred to as the "Operator".

The Operator recommends that you print or save these GTC and other legal and contractual texts to document the respective transaction.

The Operator does not store the full text of the contract for each individual transaction.

1. Scope, definitions, and contact details:

1.1 These GTC apply to all contracts concluded by the customer with the Operator for the parking services presented in this Online Shop. For the purposes of these GTC, parking services are defined as all products and services that can be booked from the Operator via the Online Shop.

1.2 The inclusion of the customer's own terms and conditions is hereby rejected, unless otherwise expressly agreed in writing with the customer.

1.3 For the purposes of these GTC, "customer" refers to both consumers and entrepreneurs.

  • 1.3.1 A consumer within the meaning of Section 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
  • 1.3.2 An entrepreneur within the meaning of Section 14 of the German Civil Code (BGB) is any natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.

1.4 You can contact the Operator by mail at the registered address: Mobility Hub Parkservice Switzerland GmbH, c/o BDO AG Obere Spichermatt 12 6370 Stans, Tel.: +41 21 561 36 30, info@mh-parkservice.ch.

2. Subject matter of the contract / Booking options:

Customers can book and pay for the following parking services via the Online Shop:

  • Online payment for parking: In accordance with these GTC, users of the parking facility specified in the product description are given the option to pay the fee due for the parking process—as a service provided without the use of remote communication—online before exiting the parking area ("Realtime Payment"), as an alternative to paying at a parking machine located on-site.
  • Digital post-payment option: In accordance with these GTC, users of the parking facility specified in the product description are given the option to pay the fee due for a completed parking process—as a service provided without the use of remote communication—online even after exiting the parking area, if the user was unable to or inadvertently failed to pay the fee due at the time of the parking process ("Postpayment"). By selecting the parking area used and entering their vehicle license plate number into the input mask provided by the Operator, the customer can check whether they are eligible for post-payment. Post-payment is available for up to 24 hours after exiting the parking area, unless otherwise specified in the product description.
  • Purchase of fixed-price tickets: In accordance with these GTC, users of the parking facility specified in the product description are given the option to purchase fixed-price tickets for a pre-determined parking duration (e.g., daily tickets or long-term parking tickets (weekly, monthly, and annual passes)).
  • Purchase of parking credit: Users with a user account registered with the Operator can purchase credit for the parking facilities specified in the product description or store a credit card or similar payment card, a bank account for direct debits, or another payment method accepted by the Operator ("Payment Method"). The parking fee due for parking processes, based on the rates valid at the time for the respective parking area—subject to any special rates for which the customer is eligible (cost-neutral or discounted use for specific user groups ("Eligible Parking"))—will be deducted from the available parking credit or charged via the stored payment method ("Pay-by-use").

Not all parking services are available for all parking areas. The respective product description in the Online Shop is decisive. The terms of use for the respective parking area posted on-site at the time of use apply to the use of the parking area itself.

The contractual partner for the use of the parking area specified in the product description is Mobility Hub Parkservice GmbH. In addition to these GTC, the General Parking Terms and Conditions of the parking area specified in the product description also apply, which can be accessed via the link provided in the product description.

3. Provisions regarding the conclusion of the contract:

3.1 The parking services presented by the Operator in the Online Shop do not constitute legally binding offers to conclude a contract, but rather serve as an invitation to the customer to submit a binding contractual offer (so-called invitatio ad offerendum).

3.2 The legally binding submission of the purchase offer by the customer for the selected parking service is made by clicking the "Pay" button. The customer is bound to this purchase offer for fourteen days from the time of booking. The Operator is entitled to reject the customer's purchase offer until it has been accepted.

3.3 The contract is only concluded once the operator sends the declaration of acceptance.

3.4 Immediately after the customer completes the booking, the operator will send a booking confirmation (payment receipt) to the email address provided by the customer in the online shop or during the payment process. This booking confirmation serves both to document the booking and fulfill the operator's legal obligations under Section 312i (1) sentence 1 no. 3 of the German Civil Code (BGB), as well as to confirm the operator's acceptance of the contract.

4. Detailed description of the booking process:

In accordance with Section 312i (1) sentence 1 no. 2 BGB in conjunction with Art. 246c no. 1 EGBGB, the operator must provide the customer with the individual technical steps leading to the conclusion of the contract.

4.1 Realtime Payment and Post Payment

4.1.1 Initiating the booking processIf a booking form is available on the website, the booking process begins by filling out and submitting the form. The customer must enter their vehicle license plate number in the designated input field. The available parking services for that area will then be displayed. The customer can now select the desired parking service. By clicking "Buy" (for fixed-price tickets) or "Pay now" (for other parking services), the customer is taken to an overview page where they can review their selected parking service, the validity period, the entered license plate number, and the price, including all additional costs. To finalize the booking for the selected service(s), the customer must click "Pay now".

4.1.2 Selecting payment method and completing the booking processThe customer is then redirected to the respective payment service provider's portal. There, they will again see an overview of the selected parking services pending booking, as well as key contract information, especially the total price. Finally, the customer can select their preferred payment method. By clicking the "Pay" button, the customer completes the booking process, thereby submitting their legally binding offer to enter into a contract.

4.2 Online Shop

4.2.1 Registration and verification for authorized parkingAt the start, the customer is prompted to enter their customer details or create a new account if they are a first-time user. If already registered, the customer can enter their details and click "Login" to access their account. To create a new account, the customer must provide their full name and email address and choose a password. If the customer belongs to a group eligible for authorized parking (e.g., as an employee of one of the operator's clients), creating an account is mandatory to access special authorized parking rates. Access to these special rates is only possible once confirmed or activated by the respective client of the operator and remains valid for the duration of the qualification granted to the customer by that client. By creating an account, the customer qualified for authorized parking confirms that they will use the parking authorization only personally, with the registered license plate, and only for the duration of the qualification granted by the operator's client (e.g., for the duration of employment, subject to the earlier termination of the contract between the operator and the client). The operator is entitled to request proof from the customer to verify eligibility for special authorized parking rates. If the customer fails to provide such proof, they are not entitled to use authorized parking. Once the customer clicks "Register," their account data is saved, and they can proceed with the ordering process as described in section 4.2.2.

4.2.2 Initiating the booking process for fixed-price ticketsIf a booking form is available on the website, the booking process begins by filling out and submitting the form. The customer must select the desired parking area. The available parking services for that area will then be displayed. The customer can select the desired parking service by clicking the "Select ticket" button and, if applicable, make further service-specific selections (e.g., specifying a usage period or date for fixed-price tickets, selecting the parking area, entering a license plate number) and add the desired parking services to the shopping cart by clicking the "Add to cart" button. The customer can then decide whether to continue shopping or proceed directly to the cart and checkout. Upon finishing their shopping and proceeding to the cart, the customer will see their selected items again, including the item description, quantity, price including all additional costs, and any separate shipping costs. To book the selected service(s), the customer must click "Buy ticket" again after reading and confirming the General Terms and Conditions and the Privacy Policy.

4.2.3 Initiating the booking process for Pay-per-UseIf a booking form is available on the website, the booking process begins by filling out and submitting the form. The customer must select the desired parking area. The available parking services for that area will then be displayed. The customer can select the "Pay-per-Use" parking service and, if applicable, make further service-specific selections (e.g., specifying a usage period, selecting the parking area, entering a license plate number) and add the desired parking services to the shopping cart by clicking the "Add to cart" button. The customer can then decide whether to continue shopping or proceed directly to the cart and checkout. Upon finishing their shopping and proceeding to the cart, the customer will see their selected items again, including the item description, usage period, and price including all additional costs. To book the selected service(s), the customer must click "Buy ticket" again after reading and confirming the General Terms and Conditions and the Privacy Policy.

4.2.4 Selecting payment method and completing the booking processFinally, the customer is redirected to the respective payment service provider's portal. Here, the customer receives an overview of the selected parking services pending booking, as well as key contract information, especially the total price and the selected parking service. By clicking the "Pay" button, the customer completes the booking process, thereby submitting their legally binding offer to enter into a contract.

5. Right of withdrawal

Existence of the statutory right of withdrawal for consumersIf the customer is a consumer as defined by Section 13 BGB ("any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession"), they have a statutory right of withdrawal. Employees and civil servants are also considered consumers under Section 13 BGB.

No right of withdrawal exists for the following services

  • Realtime-Payment (incl. fixed-price tickets that have already begun at the time of booking)
  • Postpayment
  • Pay-per-Use

The underlying main service for these parking services has already been provided without the use of distance communication. The operator merely offers the option to pay the fee owed for the service online before exiting the parking area. The right of withdrawal does not apply to distance contracts for the provision of services in the areas of accommodation for purposes other than residential purposes or for services related to leisure activities if the contract provides for a specific date or period for the provision of the service.

Provisions applicable to the right of withdrawal (cancellation policy):

Cancellation policy

Right of withdrawalYou have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us (Mobility Hub Parkservice Switzerland GmbH, c/o BDO AG Obere Spichermatt 12 6370 Stans, widerruf@mh-parkservice.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of cancellationIf you cancel this contract, we will refund all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and no later than fourteen days from the day we receive notice of your cancellation of this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund. If you requested that the service begin during the cancellation period, you must pay us a reasonable amount corresponding to the proportion of services already provided up to the time you informed us of your exercise of the right of cancellation regarding this contract, compared to the total scope of services provided for in the contract.

End of cancellation policy You can use the following form to declare your cancellation, although it is not mandatory:

Model cancellation form(If you wish to cancel the contract, please fill out this form and send it back.) Mobility Hub Parkservice Switzerland GmbH, c/o BDO AG Obere Spichermatt 12 6370 Stans, widerruf@mh-parkservice.com– I/we hereby cancel () the contract concluded by me/us () for the purchase of the following– goods ()/the provision of the following service ()– Ordered on ()/received on ()– Name of consumer(s)– Address of consumer(s)– Signature of consumer(s) (only if notified on paper)– Date

(*) Delete as applicable.

6. Customer obligations:

The customer confirms that they are of legal age and will provide truthful information required for the execution of the contract, and will immediately notify us of any changes relevant to the contractual relationship, in particular any change of address or name.

Booking processing and communication generally take place via email as part of an automated booking process. The customer must therefore provide a valid email address for booking purposes, at which emails sent by the operator can be received. In particular, it is the customer's responsibility to ensure that the receipt of emails sent by the operator is not hindered by the use of a spam filter or similar technical equipment.

The customer will not share their customer account, password, or other access credentials with third parties, and in particular will not share them with anyone.

The customer is aware that they must provide the correct license plate number of their vehicle during the booking process and that the booked long-term parking ticket is only valid for this specific vehicle and is not transferable to other vehicles, even those belonging to the customer.

7. Prices, payment terms, and refunds:

The prices stated in the operator's online shop are total prices (final prices), meaning they include all price components, including the statutory German VAT.

Bookings for fixed-price tickets or credit for pay-as-you-go, as well as payments for real-time and post-payment, are processed by the operator using the following payment methods: credit card, Sofortüberweisung, Giropay, Google Pay, Apple Pay, Link

Pay-as-you-go credit is deducted in advance after booking. If the credit chosen by the customer is used up, an automatic top-up in the amount of the previously selected credit will occur, unless the customer objects to the top-up in good time before the existing credit is exhausted. Unused credit will not be refunded.

When using pay-as-you-go, the parking fee owed for the respective parking session is based on the rates valid for the parking area at that time (in accordance with the signage present at the parking area at the time of use), unless the customer is entitled to cost-neutral or discounted use via authorized parking. The parking fee becomes due upon completion of the respective parking session and is collected via the payment method stored by the customer or deducted from the customer's existing credit. The customer hereby declares their consent to this deduction or offsetting.

8. Delivery terms:

As soon as the invoice amount has been credited to the operator, the customer will receive a confirmation via email to the address provided in the online shop or stored in their customer data with the operator after a successful booking. Parking services cannot be sent by post.

9. Liability:

The operator is liable to you in all cases of contractual and non-contractual liability for intent and gross negligence in accordance with statutory provisions for damages or reimbursement of wasted expenditure.

In other cases, the operator is liable—unless otherwise stipulated in section 8.3—only for the breach of a contractual obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance you as a customer may regularly rely (so-called cardinal duty), limited to the compensation of foreseeable and typical damage. This limitation of liability also applies to our vicarious agents. In all other cases, liability is excluded, subject to the provision in paragraph 3.

The operator's liability for damages resulting from injury to life, limb, or health and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.

10. Copyright:

The operator holds the copyright to the images, videos, and text on this website, or has obtained the rights to use images, videos, and text provided by third parties. Any use of these materials by third parties requires prior consent from the operator.

11. Jurisdiction, Applicable Law, and Contract Language:

These terms and conditions are governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer residing abroad, mandatory legal provisions of your country of residence remain unaffected. The contract language is German.

If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is the operator's registered office.

12. Code of Conduct:

The operator has not subscribed to any specific codes of conduct as defined in Art. 246c No. 5 of the Introductory Act to the German Civil Code (EGBGB).

1.3 "Customer" within the meaning of these GTC refers to both consumers and entrepreneurs.

  • 1.3.1 A consumer within the meaning of Section 13 of the German Civil Code (BGB) is every natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession.
  • 1.3.2 An entrepreneur within the meaning of Section 14 BGB is a natural or legal person or a partnership with legal personality who or which, when entering into a legal transaction, acts in exercise of their trade, business, or profession.

2. Subject Matter of the Contract / Booking Options:

Via the Online Shop, the customer can book and pay for the following parking services:

  • Online payment for the parking process: Users of the parking facility specified in the product description are granted the option, in accordance with these GTC and as an alternative to payment at a parking ticket machine located on the parking area, to pay online the fee owed for the parking process as a service rendered without the use of means of distance communication before exiting the parking area ("Realtime Payment").
  • Digital late payment option: Users of the parking facility specified in the product description are granted the option, in accordance with these GTC, to pay online the fee owed for an already completed parking process, as a service rendered without the use of means of distance communication, even for a certain time after exiting the parking area, if the user was unable or inadvertently failed to pay the fee owed for the parking process at the time of the parking process ("Postpayment"). • Purchase of parking credit: Users with a user account created with the Operator can purchase credit for the parking facilities specified for this purpose in the product description, or deposit a credit or similar payment card or a bank account for direct debits or another payment method accepted by the Operator ("Payment Method"). The parking fee owed for completed parking processes in accordance with the currently valid tariffs of the parking area, subject to any special tariffs which the customer is entitled to use (cost-neutral or discounted use by certain user groups ("Authorized Parking")), is offset against the available parking credit or collected via the deposited payment method ("Pay-by-use").

Not all parking services are available for all parking areas. The respective product description in the Online Shop is decisive. For the use of the respective parking area itself, the currently valid terms of use posted at the parking area apply.

The contracting party for the use of the parking area specified in the product description is Mobility Hub Parkservice GmbH. In addition to these GTC, the General Parking Conditions of the parking area specified in the product description, accessible via the link provided in the product description, also apply.

3. Regulations Regarding the Conclusion of the Contract:

3.1 The parking services presented by the Operator in the Online Shop do not constitute legally binding offers to conclude a contract, but serve as an invitation to the customer to submit a binding contract offer (so-called invitatio ad offerendum / invitation to treat).

3.2 The legally binding submission of the purchase offer by the customer is carried out for the respectively selected parking service by clicking the button "Pay". The customer is bound to this purchase offer for fourteen days from the submission of the booking. The Operator is entitled to reject the customer's purchase offer until acceptance.

3.3 The contract is only concluded upon receipt of the declaration of acceptance by the Operator.

3.4 Immediately upon receipt of the booking by the customer, the Operator will send a booking confirmation (payment receipt) to the email address provided by the customer for this purpose in the Online Shop or during payment. This booking confirmation serves both to document the booking and to fulfill the statutory obligations of the Operator pursuant to Section 312i (1) Sentence 1 No. 3 BGB, as well as the acceptance of the contract by the Operator.

4. Detailed Description of the Booking Process:

Pursuant to Section 312i (1) Sentence 1 No. 2 BGB in conjunction with Article 246c No. 1 EGBGB (Introductory Act to the Civil Code), the Operator must provide the customer with the individual technical steps that lead to the conclusion of the contract.

If they wish to book the selected parking service(s) now, they must click on "Pay now".

4.1.2 Selection of payment method and completion of the booking processSubsequently, the customer is redirected to the portal of the respective payment service provider. There, they will again receive an overview of the parking services they have selected that are pending booking, as well as the most important contract information, particularly the total price. Finally, the customer can select the payment method in the booking process. By pressing the button “Pay”, the customer can now complete the booking process, thereby submitting their legally binding contract offer.

If the customer wishes to create a new customer account, they must leave their full name and email address and enter a self-selected password. If the customer belongs to a group of persons eligible for Authorized Parking (e.g., as an employee of a client of the Operator), the creation of a customer account is mandatory for the utilization of special tariffs for Authorized Parking. The utilization of special tariffs for Authorized Parking is only possible upon confirmation or activation by the respective client of the Operator and for the duration of the qualification for Authorized Parking granted to the customer by the respective client of the Operator. By creating a customer account, the customer qualified for Authorized Parking guarantees to use the parking authorization granted to them only personally with the license plate number deposited for this purpose and only for the duration of the qualification for Authorized Parking granted by the client of the Operator (e.g., duration of employment, subject to the earlier termination of the contract existing between the Operator and the client). The Operator is entitled to demand appropriate proof from the customer for the utilization of special tariffs for Authorized Parking. If the customer does not provide the appropriate proof, they are not entitled to utilize Authorized Parking. The customer can now decide whether they wish to continue shopping or go directly to the shopping cart and checkout. 5. Right of Withdrawal

Statutory right of withdrawal for consumersIf you are a consumer as defined by Section 13 of the German Civil Code (BGB)—meaning a natural person entering into a legal transaction for purposes primarily outside your trade, business, or profession—you have a statutory right of withdrawal. This also applies to employees and civil servants.

There is no right of withdrawal for the following services:

  • Real-time payment (including fixed-price tickets where the start time has already passed at the time of booking)
  • Post-payment
  • Pay-per-use

The primary service for each of these parking options is provided without the use of distance communication. We simply offer the option to pay the parking fee online before you exit the facility. The right of withdrawal does not apply to distance contracts for accommodation services (other than for residential purposes) or for leisure services if the contract specifies a particular date or period for performance.

Terms applicable to the right of withdrawal (Withdrawal Policy):

Withdrawal Policy

Right of withdrawalYou have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date the contract is concluded. To exercise your right of withdrawal, please inform us (Mobility Hub Parkservice Switzerland GmbH, c/o BDO AG, Obere Spichermatt 12, 6370 Stans, widerruf@mh-parkservice.com) of your decision to withdraw via an unequivocal statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, though it is not required. To meet the deadline, it is sufficient to send your notice of withdrawal before the fourteen-day period expires.

Effects of withdrawalIf you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than our cheapest standard option), without undue delay and no later than fourteen days from the day we receive your notice of withdrawal. We will use the same payment method you used for the original transaction, unless you have expressly agreed otherwise; you will not be charged any fees for this refund. If you requested that we begin providing services during the withdrawal period, you must pay us an amount proportional to the services provided up to the time you notified us of your withdrawal, relative to the total scope of the contract.

End of the withdrawal policy

You may use the following form to withdraw, though it is not required:

You guarantee that you are of legal age, that all information provided for the contract is accurate, and that you will promptly notify us of any relevant changes, such as a change of name or address.

Booking confirmations and communications are generally handled via email as part of our automated process. You must provide a valid email address where you can receive our messages. It is your responsibility to ensure that your email provider does not block our communications via SPAM filters or other technical settings.

You agree not to share your customer account, password, or other access credentials with third parties.

You are responsible for entering the correct license plate number during the booking process. Please note that your continuous parking ticket is valid only for that specific vehicle and cannot be transferred to other vehicles, even if they belong to you.

7. Prices, Payment Terms, and Refunds:

The prices listed in our online shop are final prices, meaning they include all components, including the statutory German value-added tax (VAT).

Fixed-price tickets, Pay-by-use credit, and payments for Realtime-Payment and Postpayment are processed by the Operator using the following payment methods: Credit card, Sofort, Giropay, Google Pay, Apple Pay, and Link.

Pay-by-use credit is charged in advance upon booking. Once your credit is used up, it will automatically top up by the same amount, unless you opt out before the balance runs out. Unused credit is non-refundable.

When using Pay-by-use, your parking fee is based on the rates posted at the parking area at the time of use, unless you are eligible for free or discounted parking through an Authorized Parking agreement. Fees are due once your parking session ends and will be charged to your saved payment method or deducted from your credit balance. By using the service, you agree to these charges.

8. Delivery Terms:

General Terms and Conditions of Mobility Hub Parkservice Switzerland GmbH for online parking service bookings

Version: 14.05.2024

These General Terms and Conditions ("T&Cs"), in the version valid at the time of the respective booking, apply exclusively to the sale of parking services via the online distribution channels (hereinafter: "Online Shop") of Mobility Hub Parkservice Switzerland GmbH, legally represented by its managing directors Volker Brockmeyer, c/o BDO AG Obere Spichermatt 12 6370 Stans, Tel.: +41 21 561 36 30, info@mh-parkservice.com, hereinafter referred to as the "Operator".

The Operator recommends that you print or save these T&Cs as well as other legal and contractual texts to document the corresponding business transaction.

The Operator does not store the full text of the contract for each individual transaction.

1. Scope, definitions, and contact information:

1.1 These T&Cs apply to all contracts concluded by the customer with the Operator regarding the parking services presented in this Online Shop. Parking services within the meaning of these T&Cs include all products and services that can be booked from the Operator via the Online Shop.

1.2 The inclusion of the customer's own terms and conditions is hereby expressly rejected, unless otherwise agreed in writing with the customer.

1.3 "Customer" within the meaning of these T&Cs refers to both consumers and entrepreneurs.

  • 1.3.1 A consumer within the meaning of Section 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
  • 1.3.2 An entrepreneur within the meaning of Section 14 of the BGB is any natural or legal person or a partnership with legal capacity that, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.

1.4 You can contact the Operator by mail at the following official address: Mobility Hub Parkservice Switzerland GmbH, c/o BDO AG Obere Spichermatt 12 6370 Stans, Tel.: +41 21 561 36 30, info@mh-parkservice.com.

2. Subject of the contract / Booking options:

Via the Online Shop, the customer can book and pay for the following parking services:

  • Online payment for parking: Users of the parking facility mentioned in the product description are granted the option, in accordance with these T&Cs, to pay the parking fee online before leaving the parking area as an alternative to paying at an on-site automated pay station ("Realtime Payment").
  • Digital post-payment option: Users of the parking facility mentioned in the product description are granted the option, in accordance with these T&Cs, to pay the parking fee for a completed parking session online within a certain period after leaving the parking area, if the user was unable to pay at the time of parking or inadvertently forgot to do so ("Postpayment"). By selecting the parking area used and entering their vehicle license plate number into the input mask provided by the Operator, the customer can check if they are eligible for Postpayment. Postpayment is available for up to 24 hours after exiting the parking area, unless otherwise stated in the product description.
  • Purchase of fixed-price tickets: Users of the parking facility mentioned in the product description are granted the option, in accordance with these T&Cs, to purchase fixed-price tickets for a pre-determined parking duration (e.g., daily tickets or long-term parking tickets such as weekly, monthly, or annual passes) for the specified parking facility.
  • Purchase of parking credit: Users with a registered account can purchase credit for the parking facilities specified in the product description or register a credit card, similar payment card, bank account for direct debit, or any other payment method accepted by the Operator ("Payment Method"). The parking fee due for parking sessions, calculated according to the rates valid at the time of use—subject to any special rates the customer may be entitled to (cost-neutral or discounted use for certain user groups ("Authorized Parking"))—is deducted from the available parking credit or charged via the registered payment method ("Pay-by-use").

Not all parking services are available at every parking facility. The specific product description in the online shop is the deciding factor. For the use of the parking facility itself, the parking terms and conditions displayed on-site and in effect at the time of use apply.

The contractual partner for the use of the parking facility specified in the product description is Mobility Hub Parkservice GmbH. In addition to these GTC, the General Parking Terms and Conditions for the parking facility specified in the product description, which can be accessed via the link provided in the product description, also apply.

3. Contract conclusion regulations:

3.1 The parking services presented by the Operator in the online shop do not constitute legally binding offers to conclude a contract, but rather serve as an invitation for the customer to submit a binding contractual offer (known as an invitatio ad offerendum / invitation to treat).

3.2 The customer submits a legally binding purchase offer for the selected parking service by clicking the "Pay" button. The customer is bound by this purchase offer for fourteen days from the time the booking is submitted. The Operator is entitled to reject the customer's purchase offer until it has been accepted.

3.3 The contract is only concluded upon receipt of the acceptance declaration from the Operator.

3.4 Immediately after the customer submits the booking, a booking confirmation (payment receipt) is sent by the Operator to the email address provided by the customer in the online shop or during the payment process. This booking confirmation serves both as documentation of the booking and fulfillment of the Operator's legal obligations under Section 312i (1) sentence 1 no. 3 of the German Civil Code (BGB), as well as the Operator's acceptance of the contract.

4. Detailed booking process description:

In accordance with Section 312i (1) sentence 1 no. 2 of the BGB in conjunction with Section 246c no. 1 of the EGBGB (Introductory Act to the German Civil Code), the Operator must provide the customer with the technical steps leading to the conclusion of the contract.

4.1 Realtime Payment and Post Payment

4.1.1 Initiating the booking processIf a booking form is available on the website, the booking process begins by filling out and submitting the form. The customer must enter their vehicle license plate number in the designated input field. The parking services available for that facility will then be displayed. The customer can select the desired parking service. By clicking "Buy" (for fixed-price tickets) or "Pay now" (for other parking services), the customer is taken to a summary page where they can review the selected parking service, its validity period, the entered license plate number, and the price including all additional fees. To finalize the booking for the selected service(s), the customer must click "Pay now".

4.1.2 Selecting the payment method and completing the booking processThe customer is then redirected to the portal of the relevant payment service provider. There, they will see an overview of the parking services pending booking, along with key contractual information, including the total price. Finally, the customer can select their preferred payment method. By clicking the "Pay" button, the customer completes the booking process, thereby submitting their legally binding contractual offer.

4.2 Online Shop

4.2.1 Registration and verification for Authorized ParkingInitially, the customer is asked to enter their customer details or, if it is their first order, to create a new customer account. If the customer is already registered, they can enter their details and log in to their account by clicking "Log in". To create a new account, the customer must provide their full name, email address, and a password of their choice. If the customer belongs to a group eligible for Authorized Parking (e.g., as an employee of one of the Operator's clients), creating a customer account is mandatory to benefit from special Authorized Parking rates. Use of these special rates is only possible after confirmation or activation by the respective client of the Operator and for the duration of the eligibility granted to the customer by that client. By creating an account, the customer eligible for Authorized Parking agrees to use the parking authorization only personally with the registered license plate number and only for the duration of the eligibility granted by the Operator's client (e.g., duration of employment, subject to early termination of the contract between the Operator and the client). The Operator is entitled to request proof of eligibility for the special Authorized Parking rates. If the customer fails to provide such proof, they are not entitled to claim Authorized Parking. By clicking "Register", the customer's account data is saved, and they can proceed with the ordering process as described in section 4.2.2.

4.2.2 Initiating the booking process for fixed-price ticketsIf a booking form is available on the website, the booking process begins by filling out and submitting the form. The customer must select the desired parking facility. The available parking services for that facility will then be displayed. The customer can select the desired parking service by clicking the "Select ticket" button and, if applicable, make further service-specific selections (e.g., specifying a usage period or date for fixed-price tickets, selecting the parking area, entering license plate numbers) and add the desired services to the shopping cart by clicking "Add to cart". The customer can then choose to continue shopping or proceed directly to the cart and checkout. After finishing their selection, the customer can review the items in their cart, including the item description, quantity, and price (including all additional fees), with shipping costs listed separately. To book the selected service(s), the customer must acknowledge and accept the GTC and the privacy policy, then click "Buy ticket".

4.2.3 Initiating the booking process for Pay-per-UseIf a booking form is available on the website, the booking process begins by filling out and submitting the form. The customer must select the desired parking facility. The available parking services for that facility will then be displayed. The customer can select the desired "Pay-per-Use" parking service and, if applicable, make further service-specific selections (e.g., specifying a usage period, selecting the parking area, entering license plate numbers) and add the desired services to the shopping cart by clicking "Add to cart". The customer can then choose to continue shopping or proceed directly to the cart and checkout. After finishing their selection, the customer can review the items in their cart, including the item description, usage period, and price (including all additional fees). To book the selected service(s), the customer must acknowledge and accept the GTC and the privacy policy, then click "Buy ticket".

4.2.4 Selecting the payment method and completing the booking processFinally, the customer is redirected to the portal of the relevant payment service provider. Here, the customer receives an overview of the parking services pending booking, along with key contractual information, including the total price and the selected parking service. By clicking the "Pay" button, the customer completes the booking process, thereby submitting their legally binding contractual offer.

5. Right of withdrawal

Existence of the statutory right of withdrawal for consumersIf the customer is a consumer within the meaning of Section 13 of the BGB ("any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession"), they have a statutory right of withdrawal. Employees and civil servants are also considered consumers within the meaning of Section 13 of the BGB.

The right of withdrawal does not apply to the following services:

  • Realtime payment (including fixed-price tickets that have already started at the time of booking)
  • Post-payment
  • Pay-per-use

The primary service underlying each of these parking services has already been provided without the use of remote communication. The Operator only offers the option to pay the price due for the service online before leaving the parking area. There is no right of withdrawal for distance contracts for the provision of services in the areas of accommodation for purposes other than residential or for services related to leisure activities, if the contract provides for a specific date or period for performance.

Provisions applicable to the right of withdrawal (Information on exercising the right of withdrawal):

Information on exercising the right of withdrawal

Right of withdrawalYou have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period expires fourteen days after the day the contract is concluded. To exercise your right of withdrawal, you must inform us (Mobility Hub Parkservice Switzerland GmbH, c/o BDO AG Obere Spichermatt 12 6370 Stans, widerruf@mh-parkservice.com) of your decision to withdraw from this contract by means of an unequivocal statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawalIf you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. If you requested that the services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until the time you have communicated your withdrawal from this contract, in comparison with the full coverage of the contract.

End of information on exercising the right of withdrawal

The following form can be used to declare a withdrawal, but it is not mandatory:

6. Customer obligations:

The customer certifies that they are of legal age and will provide all information necessary for the execution of the contract truthfully, and will notify the Operator immediately of any changes relevant to the contractual relationship, in particular changes of address or name.

Booking processing and communication generally take place via email as part of an automated booking process. The customer must therefore provide a valid email address for booking processing at which emails sent by the Operator can be received. It is the customer's responsibility to ensure that the receipt of emails sent by the Operator is not hindered by the use of a spam filter or similar technical devices.

The customer shall not assign their customer account, password, or other access data to third parties, and in particular shall not share them with such persons.

The customer is aware that they must provide the correct license plate number for their vehicle during the booking process and that the reserved long-term parking ticket is only valid for this vehicle and is not transferable to other vehicles, including those belonging to the customer.

7. Prices, payment terms, and refunds:

The prices stated in the Operator's online shop are total prices (final prices), meaning they include all price components, including the statutory German value-added tax.

Bookings for fixed-price tickets or credits for pay-per-use, as well as payments for real-time payment and post-payment, are processed by the Operator using the following payment methods: credit card, Sofortüberweisung (instant bank transfer), Giropay, Google Pay, Apple Pay, Link.

Credit for pay-per-use is debited in advance after booking. If the credit chosen by the customer is exhausted, an automatic top-up in the amount of the previously selected credit will occur, unless the customer objects to the top-up in good time before the available credit is exhausted. Unused credit will not be refunded.

When using pay-per-use, the parking fee due for the respective parking process depends on the parking area rates in effect at the time (in accordance with the signage present at the parking area at the time of use), unless the customer is entitled to cost-neutral or discounted use via Authorized Parking. The parking fee becomes due at the end of the respective parking process and is charged via the payment method registered by the customer or deducted from the customer's available credit. The customer hereby declares their agreement with the charge or deduction.

8. Delivery terms:

Once the invoice amount has been received by the Operator, the customer will receive a confirmation email after a successful booking. This will be sent to the email address provided in the online shop or the one already saved in the customer's account. Parking services cannot be sent by post.

9. Liability:

The Operator is liable to you for damages or the reimbursement of wasted expenditure in all cases of contractual and non-contractual liability in the event of intent or gross negligence, in accordance with statutory provisions.

In all other cases, the Operator is only liable—unless otherwise stated in section 9.3—in the event of a breach of a contractual obligation that is essential for the proper execution of the contract and on which you, as the customer, can regularly rely (a so-called cardinal obligation). This liability is limited to the compensation of foreseeable and typical damages. This limitation of liability also applies to our vicarious agents. In all other cases, liability is excluded, subject to the provision in paragraph 3.

The Operator's liability for damages resulting from injury to life, limb, or health, as well as under the Product Liability Act, remains unaffected by the aforementioned limitations and exclusions of liability.

10. Copyright:

The Operator holds the copyright to the images, films, and texts on this website, or holds the rights to use images, films, and texts provided by third parties. Any use of these images, films, or texts by third parties always requires prior approval from the Operator.

11. Jurisdiction, applicable law, and contract language:

The contract governed by these General Terms and Conditions is subject exclusively to the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If the customer is a consumer and has their habitual residence abroad, mandatory provisions of that country remain unaffected. The language of the contract is German.

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is the registered office of the Operator.

12. Code of conduct:

The Operator has not submitted to any code of conduct as defined by Art. 246c No. 5 of the EGBGB.

6. Customer obligations:

The customer confirms that they are of legal age and will provide truthful information required for the execution of the contract. They also agree to promptly notify us of any changes relevant to the contractual relationship, particularly changes of address or name.

Booking management and communication generally take place via email as part of an automated booking process. The customer must therefore provide a valid email address for booking management where they can receive emails sent by the operator. It is the customer's responsibility to ensure that the receipt of emails from the operator is not blocked by spam filters or similar technical devices.

The customer shall not transfer their customer account, password, or other access data to third parties, nor share them with anyone else.

The customer acknowledges that they must provide the correct vehicle license plate number during the booking process and that the booked long-term parking ticket is valid only for that specific vehicle and is not transferable to other vehicles, even those belonging to the customer.

7. Prices, payment terms, and refunds:

The prices stated in the operator's online shop are total prices (final prices), meaning they include all price components, including the statutory German value-added tax.

Bookings for fixed-price tickets or pay-by-use credit, as well as payments for real-time and post-payment services, are processed by the operator using the following payment methods: credit card, Sofortüberweisung (instant bank transfer), Giropay, Google Pay, Apple Pay, and Link.

Pay-by-use credit is charged in advance after booking. If the credit selected by the customer is exhausted, an automatic top-up equal to the previously selected credit amount will be triggered, unless the customer opts out in good time before the available credit runs out. Unused credit is non-refundable.

When using the pay-by-use service, the parking fee due for each parking session is based on the rates valid for the parking area at that time (in accordance with the signage posted at the parking area during use), unless the customer is entitled to free or discounted use via an authorized parking permit. The parking fee becomes due upon completion of the parking session and is collected via the customer's stored payment method or deducted from their available credit. The customer hereby consents to this charge or deduction.

8. Delivery terms:

Once the invoice amount has been credited to the operator, the customer will receive a confirmation email for their successful booking at the address provided in the online shop or stored in their customer profile. Parking services cannot be delivered by post.

9. Liability:

The operator is liable to you in all cases of contractual and non-contractual liability for intent and gross negligence in accordance with statutory provisions for damages or the reimbursement of wasted expenditure.

In other cases, the operator is only liable—subject to the provisions in section 9.3—in the event of a breach of a contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on which you as a customer can regularly rely (so-called cardinal obligation). This liability is limited to the compensation of foreseeable and typical damage. This limitation of liability also applies to our agents. In all other cases, liability is excluded, subject to the provision in paragraph 3.

The operator's liability for damages resulting from injury to life, body, or health, as well as under the Product Liability Act, remains unaffected by the aforementioned limitations and exclusions of liability.

10. Copyright:

The operator holds the copyright to the images, videos, and texts on this website, or holds usage rights for third-party content. Any use of these images, videos, or texts by third parties requires prior permission from the operator.

11. Jurisdiction, applicable law, and contract language:

Contracts governed by these T&Cs are subject exclusively to the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If the customer is a consumer and has their habitual residence abroad, mandatory provisions of that country remain unaffected. The contract language is German.

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is the Operator's registered office.

12. Code of conduct:

The Operator has not submitted to any code of conduct as defined in Section 246c No. 5 of the EGBGB.
