Allgemeine Geschäftsbedingungen

General Terms and Conditions of Mobility Hub Parkservice Italia GmbH for the online booking of parking services

Last updated: 14.05.2024

The following General Terms and Conditions ("GTC") apply exclusively in the version valid at the time of the respective booking to the sale of parking services via online sales channels (hereinafter: "Online Shop") of Mobility Hub Parkservice Italia GmbH, legally represented by its Managing Director Volker Brockmeyer, Piazza della Mostra 2, I - 39100 Bolzano (BZ), Phone: +39 04711430501, info@mh-parkservice.it, hereinafter referred to as the "Operator".

The Operator recommends that you print or save these GTC and the other legal and contractual texts to document the respective transaction.

The Operator does not store the full text of the contract for each individual transaction.

1. Scope, definitions, and contact information:

1.1 These GTC apply to all contracts concluded by the customer with the Operator for the parking services presented in this Online Shop. For the purposes of these GTC, parking services are defined as all products and services that can be booked from the Operator via the Online Shop.

1.2 The inclusion of the customer's own terms and conditions is hereby rejected, unless otherwise expressly agreed in writing with the customer.

1.3 For the purposes of these GTC, "customer" refers to both consumers and entrepreneurs.

  • 1.3.1 A consumer within the meaning of Section 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
  • 1.3.2 An entrepreneur within the meaning of Section 14 of the German Civil Code (BGB) is any natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.

1.4 You can contact the Operator by mail at Mobility Hub Parkservice Italia GmbH, Piazza della Mostra 2, I - 39100 Bolzano (BZ), by phone at +39 04711430501, or via email at info@mh-parkservice.it.

2. Subject matter of the contract / Booking options:

2.1 Customers can book and pay for the following parking services via the Online Shop:

  • Online payment for parking: In accordance with these GTC, users of the parking facility specified in the product description are given the option to pay the fee due for the parking process—as a service provided without the use of remote communication—online before exiting the parking area, as an alternative to paying at a parking machine located on-site ("Realtime Payment").
  • Digital post-payment option: In accordance with these GTC, users of the parking facility specified in the product description are given the option to pay the fee due for a completed parking process—as a service provided without the use of remote communication—online even after exiting the parking area, if the user was unable to pay or inadvertently failed to pay the fee due at the time of the parking process ("Postpayment"). By selecting the parking area used and entering their vehicle license plate number into the input mask provided by the Operator, the customer can check whether they are eligible for post-payment. Post-payment is available for up to 24 hours after exiting the parking area, unless otherwise specified in the product description.
  • Purchase of fixed-price tickets: In accordance with these GTC, users of the parking facility specified in the product description are given the option to purchase fixed-price tickets for a pre-determined parking duration (e.g., daily tickets or long-term parking tickets (weekly, monthly, and annual passes)).
  • Purchase of parking credit: Users with a registered account with the Operator can purchase credit for the parking facilities specified in the product description or store a credit card, similar payment card, or other payment method accepted by the Operator ("Payment Method"). The parking fee due for parking sessions, based on the rates valid at the time for the respective parking area—subject to any special rates the customer may be entitled to (cost-neutral or discounted use for specific user groups ("Authorized Parking"))—will be deducted from the available parking credit or charged via the stored payment method ("Pay-by-use").

Not all parking services are available for all parking areas. The respective product description in the Online Shop is decisive. For the use of the parking area itself, the terms of use posted on-site at the time of use apply.

2.2 The contractual partner for the use of the parking area specified in the product description is Mobility Hub Parkservice Italia GmbH. In addition to these GTC, the General Parking Terms and Conditions of the parking area specified in the product description also apply, which can be accessed via the link provided in the product description.

3. Contract conclusion:

3.1 The parking services presented by the Operator in the Online Shop do not constitute legally binding offers to conclude a contract, but rather serve as an invitation to the customer to submit a binding contractual offer (so-called invitatio ad offerendum).

3.2 The customer submits a legally binding purchase offer for the selected parking service by clicking the "Pay" button. The customer is bound to this purchase offer for a period of fourteen days from the time of booking. The Operator is entitled to reject the customer's purchase offer until it has been accepted.

3.3 The contract is only concluded upon receipt of the acceptance declaration from the Operator. Immediately after the customer's booking is received, the Operator will send a booking confirmation (payment receipt) to the email address provided by the customer in the Online Shop or during the payment process. This booking confirmation serves both to document the booking and fulfill the Operator's legal obligations under Section 312i (1) sentence 1 no. 3 of the German Civil Code (BGB), as well as to confirm the Operator's acceptance of the contract.

6. Customer Obligations:

6.1 The customer confirms that they are of legal age, will provide truthful information required for the execution of the contract, and will promptly notify us of any changes relevant to the contractual relationship, particularly changes of address or name.

6.2 Booking processing and communication generally take place via email as part of an automated booking system. The customer must therefore provide a valid email address for booking purposes where emails sent by the operator can be received. In particular, it is the customer's responsibility to ensure that the receipt of emails sent by the operator is not hindered by spam filters or similar technical measures.

6.3 The customer will not share their customer account, password, or other access credentials with third parties.

6.4 The customer acknowledges that they must provide the correct license plate number for their vehicle during the booking process and that the booked long-term parking ticket is valid only for that specific vehicle and cannot be transferred to other vehicles, even those belonging to the customer.

7. Prices, Payment Terms, and Refunds:

7.1 The prices stated in the operator's online shop are total prices (final prices), meaning they include all price components, including the statutory German VAT.

7.2 Bookings for fixed-price tickets or pay-as-you-go credit, as well as payments for real-time and post-payment services, are processed by the operator using the following payment methods: credit card, Sofortüberweisung, Google Pay, Apple Pay, and Link.

7.4 When using pay-as-you-go, the parking fee for each session is based on the rates valid at the parking area at that time (as indicated by the signage present at the time of use), unless the customer is entitled to free or discounted parking. The parking fee becomes due at the end of each parking session and will be charged to the customer's stored payment method or deducted from their existing credit. The customer hereby agrees to this billing or deduction.

8. Delivery Terms:

Once the invoice amount has been credited to the operator, the customer will receive a confirmation email after a successful booking, sent to the email address provided in the online shop or stored in their customer profile. Parking services cannot be sent by post.

9. Liability:

9.1 The operator is liable to you in all cases of contractual and non-contractual liability for intent and gross negligence in accordance with statutory provisions for damages or reimbursement of wasted expenditure.

9.2 In other cases, the operator is only liable—unless otherwise stipulated in Section 9.3—in the event of a breach of a contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on whose compliance you as a customer may regularly rely (so-called cardinal duty), limited to the compensation of foreseeable and typical damage. This limitation of liability also applies to our vicarious agents. In all other cases, liability is excluded, subject to the provision in paragraph 3.

9.3 The operator's liability for damages resulting from injury to life, limb, or health, and under the Product Liability Act, remains unaffected by the above limitations and exclusions of liability.

10. Copyright:

The operator holds the copyright to the images, videos, and text on this website or has obtained the rights to use third-party content. Any use of these images, videos, or text by third parties requires prior approval from the operator.

11. Jurisdiction, applicable law, and contract language:

11.1 Contracts governed by these terms and conditions are subject exclusively to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer with a habitual residence abroad, mandatory provisions of that country remain unaffected. The contract language is German.

11.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is the operator's registered office.

12. Code of conduct:

The operator has not committed to any specific codes of conduct as defined in Art. 246c No. 5 of the EGBGB.

General Terms and Conditions of Mobility Hub Parkservice Italia GmbH for online parking reservations

Last updated: 14.05.2024

The following General Terms and Conditions ("GTC") apply in the version valid at the time of booking exclusively to the sale of parking services via the online sales channels (hereinafter: "Online Shop") of Mobility Hub Parkservice Italia GmbH, legally represented by its Managing Director Volker Brockmeyer, Piazza della Mostra 2, I - 39100 Bolzano (BZ), Phone: +39 04711430501, info@mh-parkservice.it, hereinafter referred to as the "Operator".

The operator recommends that you print or save these GTC and other legal and contractual documents for your records regarding the respective transaction.

The operator does not store the full text of the contract for each individual transaction.

1. Scope, definitions, and contact information:

1.1 These GTC apply to all contracts concluded between the customer and the operator for the parking services offered in this online shop. Parking services within the meaning of these GTC include all products and services that can be booked from the operator via the online shop.

1.2 The inclusion of the customer's own terms and conditions is rejected unless otherwise expressly agreed upon in writing.

  • 1.3.2 An entrepreneur within the meaning of Section 14 of the BGB is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

1.4 You can contact the operator by mail at Mobility Hub Parkservice Italia GmbH, Piazza della Mostra 2, I - 39100 Bolzano (BZ), by phone at +39 04711430501, or via email at info@mh-parkservice.it.

2. Subject of the contract / booking options:

2.1 Customers can book and pay for the following parking services via the online shop:

  • Online payment for parking sessions: In accordance with these T&Cs, users of the parking facility specified in the product description have the option to pay the fee due for a parking session as a service provided without the use of online distance communication means before leaving the parking facility ("real-time payment"), as an alternative to paying at a payment machine installed on-site.
  • Digital post-payment option: In accordance with these T&Cs, users of the parking facility indicated in the product description are given the option to pay the fee due for a completed parking session—as a service provided without the use of distance communication means—online for a specific period after exiting the parking area, provided the user was unable to pay the fee at the time of parking or inadvertently failed to do so ("post-payment"). By selecting the parking facility used and entering their vehicle's license plate number into the operator's designated form, the customer can check if they are eligible for post-payment. Post-payment is available for up to 24 hours after exiting the parking facility, unless otherwise specified in the product description.
  • Purchase of fixed-price tickets: Users of the parking facility indicated in the product description have the option to purchase fixed-price tickets for a pre-defined parking period (e.g., day tickets or long-term parking tickets such as weekly, monthly, or annual passes) for the parking facility indicated in the product description in accordance with these T&Cs.
  • Purchase of parking credit: Users with a registered account with the operator can purchase credit for the parking facilities specified for this purpose in the product description, or store a credit card, similar payment card, or another payment method accepted by the operator ("payment method"). The parking fee due for parking transactions, based on the parking area's current rates—subject to any special rates the customer may be entitled to (zero-cost or discounted use by specific user groups ("authorized parking"))—is offset against the available parking credit or charged via the stored payment method ("pay-by-use").

Not all parking services are available for every parking facility. The product description in the online shop is definitive. For the actual use of the parking facility, the parking terms and conditions posted on-site at that time apply.

2.2 The contractual partner for the use of the parking facility indicated in the product description is Mobility Hub Parkservice Italia GmbH. In addition to these T&Cs, the General Parking Terms and Conditions for the specific parking facility apply, which can be accessed via the link provided in the product description.

3. Contract conclusion regulations:

3.1 The parking services presented by the operator in the online shop do not constitute legally binding offers to enter into a contract, but rather serve as an invitation to the customer to submit a binding contractual offer (an invitatio ad offerendum).

3.2 The customer submits a legally binding purchase offer for the selected parking service by clicking the "Pay" button. The customer is bound by this purchase offer for fourteen days from the time of booking. The operator is entitled to reject the customer's purchase offer until it has been accepted.

3.3 The contract is only concluded upon receipt of the operator's declaration of acceptance. Immediately after receiving the customer's booking, the operator will send a booking confirmation (payment receipt) to the email address provided by the customer in the online shop or at the time of payment. This booking confirmation serves both to document the booking and fulfill the operator's legal obligations under § 312i (1) sentence 1 no. 3 of the German Civil Code (BGB), and as the operator's acceptance of the contract.

4. Detailed description of the booking process:

Pursuant to § 312i (1) sentence 1 no. 2 BGB in conjunction with Art. 246c no. 1 EGBGB, the operator must provide the customer with the individual technical steps leading to the conclusion of the contract.

4.1 Real-time payment and post-payment

4.1.1 Starting the booking processIf a booking form is available on the website, the booking process begins by filling out and submitting this form. The customer can now select the desired parking service. By clicking "Buy" (for fixed-price tickets) or "Pay now" (for other parking services), the customer is directed to a summary page showing the selected parking service, the validity period, the license plate number, and the price, including all additional costs. To book the selected parking service, the customer must then click "Pay now".

4.1.2 Selecting the payment method and completing the booking processThe customer is then redirected to the respective payment service provider's portal. Here, an overview of the selected parking services available for booking is provided, along with key contract information, particularly the total price. Finally, the customer can select their payment method. By clicking the "Pay" button, the customer completes the booking process by submitting a legally binding contractual offer.

4.2 Online shop

4.2.1 Registration and verification for parking authorizationInitially, the customer is asked to enter their customer details or create a new account. If the customer is already registered, they can enter their details and log in by clicking "Login". To create a new account, the customer must enter their first and last name, email address, and a password of their choice. If the customer belongs to a group eligible for authorized parking (e.g., as an employee of one of the operator's clients), creating an account is mandatory to use special authorized parking rates. Use of these special rates is only possible after confirmation or activation by the respective client of the operator and for the duration of the authorization granted to the customer. By creating an account, the customer confirms that they will use the parking authorization only personally with the registered license plate and only for the duration of the authorization granted (e.g., duration of employment, subject to early termination of the contract between the operator and the client). The operator has the right to request appropriate proof of eligibility for special authorized parking rates. If the customer fails to provide such proof, they are not authorized to use the parking facility. Once the customer clicks "Register", their account details will be saved, and they can proceed with the ordering process as described in section 4.2.2.

4.2.2 Starting the booking process for fixed-price ticketsIf a booking form is available on the website, the booking process begins by filling out and submitting this form. The customer must select the desired parking facility. The available parking services for that area will then be displayed. The customer can select the desired parking service by clicking the "Select ticket" button and, if necessary, make further specific selections (e.g., specifying a usage period or date for fixed-price tickets, selecting the parking area, or entering license plate numbers) and add the desired services to the shopping cart by clicking "Add to cart". At this point, the customer can choose to continue shopping or proceed directly to the cart and checkout. After completing their selection, the customer will see the items in their cart, including the item description, quantity, price (including all additional costs), and any separate shipping fees. To book the selected parking service(s), the customer must click "Buy ticket" after acknowledging and confirming the terms and conditions and the privacy policy.

4.2.3 Starting the booking process for pay-per-use parkingIf a booking form is available on the website, the booking process begins by filling out and submitting this form. The customer must select the desired parking facility. The available parking services for that area will then be displayed. The customer can select the desired "pay-per-use" parking service, make further specific selections (e.g., specifying a usage period, selecting a parking space, or entering license plate numbers), and add the desired services to the shopping cart by clicking "Add to cart". At this point, the customer can choose to continue shopping or proceed directly to the cart and checkout. After completing their selection, the customer will see the items in their cart, including the item description, usage period, and price (including all additional costs). To book the selected parking service(s), the customer must click "Buy ticket" after acknowledging and confirming the terms and conditions and the privacy policy.

4.2.4 Selecting the payment method and completing the booking processFinally, the customer is redirected to the respective payment service provider's portal. Here, the customer receives an overview of the selected parking services available for booking, as well as the most important contract information, particularly the total price and the selected parking service. By clicking the "Pay" button, the customer completes the booking process by submitting their legally binding contractual offer.

5. Right of withdrawal

5.1 Existence of the statutory right of withdrawal for consumersIf the customer is a consumer within the meaning of § 13 BGB ("any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession"), they have a statutory right of withdrawal. Employees and civil servants are also considered consumers within the meaning of § 13 BGB.

The right of withdrawal does not apply to the following services:

  • Real-time payment (including fixed-price tickets where the start date has already passed at the time of booking)
  • Post-payment
  • Pay-per-use payments

The core service underlying each of these parking services has already been provided without the use of distance communication. The operator only offers the option to pay the parking fee online before leaving the parking facility. The right of withdrawal does not apply to distance contracts for the provision of services in the areas of accommodation for purposes other than residential, or for the provision of services related to leisure activities, if the contract specifies a particular date or period for the provision of services.

5.2 Provisions applicable to the right of withdrawal (cancellation policy):

Cancellation policy

Right of cancellationYou have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day the contract is concluded. To exercise your right of cancellation, you must inform us (Mobility Hub Parkservice Italia GmbH, Piazza della Mostra 2, I - 39100 Bolzano (BZ), widerruf@mh-parkservice.com) of your decision to cancel this contract by a clear statement (e.g., a letter sent by post or email). You may use the attached model cancellation form, but it is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

Consequences of cancellationIf you cancel this contract, we will reimburse all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we are informed about your decision to cancel this contract. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. If you requested that the service begin during the cancellation period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your cancellation from this contract, in comparison with the full coverage of the contract.

End of the cancellation policy

5.3 The following form may be used to declare cancellation, but it is not mandatory:

6.2 Bookings are generally processed and communicated via email as part of an automated booking process. The customer must therefore provide a valid email address for booking processing, at which emails sent by the operator can be received. In particular, it is the customer's responsibility to ensure that the receipt of emails sent by the operator is not hindered by the use of a SPAM filter or similar technical devices.

6.3 The customer shall not make their customer account, password, or other access data available to third parties, and in particular shall not share them with third parties.

6.4 The customer is aware that they must provide the correct license plate number of their vehicle during the booking process and that the booked long-term parking ticket is valid only for this vehicle and is not transferable to other vehicles, including those belonging to the customer.

7. Prices, payment terms, and refunds:

7.1 The prices stated in the operator's online shop are total prices (final prices), meaning they include all price components, including the applicable German VAT.

7.2 Bookings for fixed-price tickets or pay-per-use credits, as well as payments for real-time and post-payment, are processed by the operator using the following payment methods: Credit card, Sofortüberweisung, GooglePay, Apple Pay, Link.

7.3 Pay-per-use credit is charged in advance after booking. If the credit selected by the customer is exhausted, an automatic top-up of the previously selected credit amount will be performed, unless the customer objects to the top-up in good time before the existing credit is exhausted. Unused credit will not be refunded.

7.4 If you use the pay-by-use option, the parking fee for your session is based on the rates posted at the parking facility at the time of use, unless you are entitled to free or discounted parking through an authorized permit. Parking fees are due at the end of your session and will be charged to your saved payment method or deducted from your existing account balance. By using the service, you agree to these charges or deductions.

8. Delivery Terms:

Once your payment has been received, you will get a confirmation email sent to the address provided in our online shop or the one saved in your account. Parking services cannot be delivered by mail.

9. Liability:

9.1 The operator is liable for damages or wasted expenses in accordance with statutory provisions in all cases of contractual and non-contractual liability involving intent or gross negligence.

9.2 In other cases, the operator is only liable—unless otherwise specified in Section 9.3—for breaches of essential contractual obligations (cardinal obligations) that are necessary for the proper execution of the contract and on which the customer can typically rely. In these cases, liability is limited to foreseeable and typical damages. This limitation also applies to our agents. All other liability is excluded, subject to the provisions in paragraph 3.

9.3 The operator's liability for damages resulting from injury to life, body, or health, as well as liability under the Product Liability Act, remains unaffected by the above limitations and exclusions.

10. Copyright:

The operator owns the copyright to all images, videos, and text on this website, or holds the rights to use third-party content. Any use of these materials by third parties requires prior permission from the operator.

11. Jurisdiction, Applicable Law, and Contract Language:

11.1 These terms and the contract are governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer residing abroad, mandatory legal provisions of your home country remain unaffected. The contract language is German.

11.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is the operator's registered office.

12. Code of Conduct:

The operator is not subject to any specific codes of conduct as defined by Art. 246c No. 5 EGBGB.
