‍General Terms and Conditions of Mobility Hub Parkservice Austria GmbH for the use of the Business Parking Portal and the provision of business parking services

Last updated: 25.08.2026

Mobility Hub Parkservice Austria GmbH, legally represented by its Managing Director Maximilian Schlereth, Krottenseestraße 45, 4810 Gmunden, Tel.: +43 72 011 69 48, info@mh-parkservice.at, hereinafter referred to as the “Operator”, provides parking management services for parking lots or parking garages (hereinafter each referred to as a “Parking Area”) using a barrier-free digital parking management solution based on automated license plate recognition upon entry and exit.

The following General Terms and Conditions (“GTC”) apply exclusively in their current version to the use of the Business Parking Portal accessible at business.mh-parkservice.com (hereinafter: “Business Parking Portal”) operated by the Operator, and to the sale or billing of parking services via the Business Parking Portal.

The Operator recommends that you print or save these GTC and other legal and contractual documents for your records regarding each transaction.

The Operator does not store the full text of the contract for each individual transaction.

1. Scope, Definitions, User Account, and Contact Information:

1.1 Only entrepreneurs as defined by § 1 of the Austrian Commercial Code (UGB) (in particular commercial tenants of business premises adjacent to a parking area managed by the Operator)—meaning any natural or legal person or partnership with legal capacity that operates an ongoing independent economic activity (a business), regardless of whether it is profit-oriented—are entitled to use the Business Parking Portal and are considered a “Customer” under these GTC.

1.2 These GTC apply (a) to the use of the Business Parking Portal by the Customer or by the administrator appointed by the Customer as the central contact person for the Business Parking Portal, who has sufficient decision-making authority and is authorized to represent the Customer in all matters relating to the Business Parking Portal (“Administrator”), and (b) to all contracts concluded by the Customer with the Operator for the parking services presented in the Business Parking Portal or these GTC. Parking services within the meaning of these GTC include all products and services that can be booked with the Operator via the Business Parking Portal or provided by the Operator in accordance with these GTC.

1.3 The inclusion of the Customer’s own terms and conditions is hereby rejected, unless otherwise expressly agreed in writing with the Customer.

1.4 In accordance with the description in the Business Parking Portal, the Operator enables the Customer to:

  • i) Manage fixed parking space quotas: The Customer can enter and manage license plates authorized for automatic recognition and eligibility checks for parking spaces or quotas rented from the Operator or their landlord. The maximum number of license plates that can be entered is specified in the Business Parking Portal.
  • ii) Utilize additional parking spaces and manage over-usage: Upon payment of an over-usage fee based on the valid tariff stored in the Business Parking Portal at the time, the Customer is entitled to have more vehicles with authorized license plates use the parking area than the number of spaces rented by the Customer (“Over-usage”). The license plate recognition system installed in the parking area automatically detects when over-usage occurs and calculates an over-usage fee in accordance with Section 6.2.
  • iii) Purchase fixed-price tickets: Where provided for in the Business Parking Portal, the Customer may purchase fixed-price tickets for the parking area for a pre-determined parking duration (e.g., long-term parking tickets such as weekly, monthly, or annual passes) as described in the Business Parking Portal.

1.5 Active use of the Business Parking Portal requires registration and the creation of a user account. The Customer will receive an invitation email from their landlord or the Operator for this purpose. To register and create the user account, the Administrator must provide at least the following information for the Customer: company name, Administrator name, email address, street and house number, postal code, and city. Providing a payment method is mandatory for registration and account creation.

1.6 To confirm registration, the Administrator will receive an activation link at the email address provided, which must be clicked to complete the registration for the Customer (a process known as “double opt-in”).

1.7 All information provided by the Customer must be truthful. If any data provided during registration changes, the Customer is obliged to update it immediately in their user account via the settings in the Business Parking Portal. The Customer must ensure that the payment method provided always has sufficient funds. If the Customer fails to meet these obligations, the Operator is entitled to charge for any additional expenses and costs incurred (e.g., for address inquiries, returned direct debits, etc.).

1.8 You can contact the Operator by mail at the registered address: Mobility Hub Parkservice Austria GmbH, Krottenseestraße 45, 4810 Gmunden, by phone at +43 72 011 69 48, or by email at info@mh-parkservice.at.

2. Activation for billing of over-usage

2.1 When registering the user account, the Customer must provide and verify a valid payment method in the billing details. Upon completion of registration, the Customer may enter up to the number of authorized license plates specified in the Business Parking Portal. Cashless billing and payment for over-usage will then be processed automatically via the Customer’s user account and the selected payment method in accordance with Section 6.

2.2 By completing the registration, the Customer authorizes the Operator to bill for all over-usage incidents involving the license plates provided. The Customer acknowledges that by entering license plates into the Business Parking Portal, all parking activities in the parking area involving vehicles with those license plates that exceed the number of rented parking spaces will be billed via the stored payment method.

2.3 The Customer is advised that payment at any parking machines that may be present in the parking area is not possible for the license plates they have registered.

3. Activation for usage billing

3.1 When registering a user account, the customer must provide and verify a valid payment method in the billing details. Upon completing registration, the customer may enter up to the maximum number of authorized license plates specified in the Business Parking Portal. Cashless billing and payment for parking usage will subsequently be processed automatically via the customer's user account and their chosen payment method, in accordance with Section 6.

3.2 By completing registration, the customer authorizes the operator to bill for all parking sessions conducted with the license plates they have provided. The customer acknowledges that once license plates are registered in the Business Parking Portal, all parking sessions on the premises involving the vehicle with the specified license plate will be charged to the customer's stored payment method.

3.3 The customer is advised that for any license plates they have registered, payment at a parking meter that may be present on the premises is not possible.

4. Fixed-price tickets

4.1 If fixed-price tickets are displayed by the operator in the Business Parking Portal, this does not constitute a legally binding offer to enter into a contract, but rather an invitation to the customer to submit a binding contractual offer (invitatio ad offerendum).

4.2 The customer submits a legally binding purchase offer by selecting a fixed-price ticket and clicking the "Order with obligation to pay" button. The customer is bound by this purchase offer for fourteen days from the time of booking. The operator reserves the right to reject the customer's purchase offer until it has been accepted.

4.3 The contract is only concluded upon receipt of the acceptance declaration from the operator. Immediately after the customer completes the booking, the operator will send a booking confirmation (payment receipt) to the email address provided by the customer in the Business Parking Portal or during the payment process. This booking confirmation serves both as documentation of the booking and fulfillment of the operator's legal obligations under Sections 9 et seq. of the E-Commerce Act (ECG), as well as the operator's acceptance of the contract.

4.4 Once the invoice amount has been credited to the operator, the customer will receive a confirmation email after a successful booking, sent to the email address specified in the Business Parking Portal or stored in their customer profile. Fixed-price tickets cannot be sent by post.

4.5 Unless otherwise stated in the Business Parking Portal, the customer has no claim to the assignment of a specific parking space on the premises. The customer merely receives authorization to use the parking area for the duration of the fixed-price ticket with a license plate they have registered as authorized.

5. Customer obligations:

5.1 The customer is responsible for compliance with these General Terms and Conditions, including by any administrator they have appointed.

5.2 The customer acknowledges that providing correct license plate information is essential for proper authorization checks and the billing of parking sessions. The customer shall indemnify the operator against all third-party claims and any damages resulting from the customer's incorrect entry of a license plate. The customer may deactivate or change license plates independently via the Business Parking Portal. However, registered license plates are locked during active parking sessions.

5.3 Booking processing and communication generally take place via email as part of an automated system. Therefore, when setting up a user account, the customer must provide a valid email address at which emails sent by the operator can be received. In particular, it is the customer's responsibility to ensure that the receipt of emails sent by the operator is not hindered by the use of spam filters or similar technical measures.

5.4 The customer shall not disclose the user account, password, or other access credentials to any third party, nor share them, with the exception of the administrator and users appointed by the customer. The customer must ensure that the use of paid services via the user account is carried out exclusively by the administrator and authorized users.

5.5 The customer agrees to notify the operator immediately if they become aware of, or have reason to suspect, that an unauthorized third party has gained access to the user account password, or that a password or user account is being used without authorization.

6. Prices, payment terms, and refunds:

6.1 The prices stated in the operator's Business Parking Portal are gross prices, meaning they include the statutory Austrian value-added tax (VAT).

6.2 When billing for excess usage, the excess usage fee owed for the respective parking session is based on the prices valid at that time, which were made known to the customer via the Business Parking Portal. The excess usage fee is charged upon completion of the respective parking session and collected monthly in arrears via the customer's stored payment method. The customer hereby consents to this debiting process.

6.3 Fixed-term rented parking spaces are invoiced to the customer in advance and collected via the customer's stored payment method. The customer hereby consents to this debiting process.

7. Liability:

7.1 The Operator is only liable for damages in all applicable cases in the event of intent or gross negligence. In cases of slight negligence, the Operator is liable exclusively for personal injury.

7.2 The Operator is not liable for indirect damages, loss of profit, loss of interest, unrealized savings, consequential damages, financial losses, claims by third parties, or for the loss of data and programs and their recovery.

7.3 In other cases, the Operator is liable—unless otherwise stipulated in Section 7.4—only for the breach of a contractual obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance the customer may regularly rely (so-called cardinal obligation), limited to the compensation of foreseeable and typical damages. This limitation of liability also applies to our vicarious agents. In all other cases, liability is excluded, subject to the provisions in Section 7.4.

7.4 The Operator's liability for damages resulting from injury to life, limb, or health and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.

8. Data Protection

Information on data protection can be viewed by the customer at https://www.mh-parkservice.com/at/datenschutz/.

9. Copyrights:

The Operator holds copyrights to images, films, and texts on the Business Parking Portal, or holds usage rights to images, films, and texts belonging to third parties. Any use of these images, films, and texts by third parties therefore always requires prior inquiry with the Operator.

10. Place of Jurisdiction, Applicable Law, and Contract Language:

10.1 The contract under these GTC is subject exclusively to the laws of the Republic of Austria, excluding conflict-of-law rules and the UN Sales Convention. The contract language is German.

10.2 For all legal disputes arising from or in connection with these GTC and contracts under these GTC, including the valid agreement, its fulfillment, and pre-contractual and post-contractual effects, the exclusive jurisdiction of the competent courts in Gmunden is agreed.

10.3 Should one or more provisions of these GTC be or become invalid or void, or contain a loophole, the validity of the remaining provisions shall remain unaffected. The parties undertake to replace the invalid or void provision with a valid regulation that comes closest to what the parties intended according to the meaning of the invalid or void provision.

11. Code of Conduct:

The Operator has not submitted to any codes of conduct as defined by Section 9 (2) of the E-Commerce Act (ECG).

The following General Terms and Conditions of Business and Use ("GTC"), in the version valid at the relevant time, apply exclusively to the use of the Operator's Business Parking Portal accessible at business.mh-parkservice.com (hereinafter: the "Business Parking Portal") and to the sale and billing of parking services via the Business Parking Portal.

We recommend that you print or save these GTC and any other legal or contractual documents related to your transaction. We do not keep a comprehensive record of the specific contractual texts for every transaction.

1. Scope, Definitions, User Account, and Contact Details

1.1 Only entrepreneurs as defined by Section 1 of the Austrian Commercial Code (UGB) are eligible to use the Business Parking Portal and qualify as a "Customer" under these GTC (this includes commercial tenants of premises near a parking facility managed by us). This applies to any natural person, legal entity, or partnership with legal capacity that conducts independent economic activity, regardless of whether the activity is profit-oriented.

1.2 These GTC apply to (a) the use of the Business Parking Portal by the Customer or their designated administrator—who must have the authority to make decisions and represent the Customer in all matters related to the portal—and (b) all contracts between the Customer and the Operator regarding parking services offered through the portal or these GTC. Parking services include all products and services bookable via the portal or provided by us under these GTC.

1.3 We do not accept any of the Customer's own terms and conditions unless we have explicitly agreed to them in writing.

1.4 As described in the Business Parking Portal, we provide the following features for the Customer:

(i) Managing fixed parking quotas: Customers can enter and manage license plate numbers for automatic recognition and verification for parking spaces rented from us or their landlord. The maximum number of license plates allowed is shown in the portal.

(ii) Using additional parking and managing excess use: If you use more parking spaces than you have rented, you will be charged an excess use fee based on the current tariff in the portal. Our license plate recognition system automatically detects this and calculates the fee as per Clause 6.2.

(iii) Purchasing fixed-price tickets: Where available, you can purchase fixed-price tickets for specific durations (e.g., weekly, monthly, or annual passes) for the parking facility, as detailed in the portal.

1.5 To use the portal, you must register and create a user account. You will receive an invitation email from your landlord or from us. During registration, your administrator must provide the company name, administrator name, email address, and business address. You must also link a payment method to your account.

1.6 To finish setting up your account, your administrator will receive an activation link via email, which must be clicked to complete the registration (the "double opt-in" process).

1.7 All information provided must be accurate. If your details change, please update them immediately in your account settings. You are responsible for ensuring your payment method has sufficient funds. If you fail to meet these obligations, we reserve the right to charge you for any resulting costs, such as administrative fees or returned direct debit charges.

1.8 You can reach us by mail at Mobility Hub Parkservice Austria GmbH, Krottenseestraße 45, 4810 Gmunden, Austria, by phone at +43 72 011 69 48, or by email at info@mh-parkservice.at.

2. Activation for Excess Use Billing

2.1 Upon registration, you must add and verify a valid payment method. Once registered, you can enter up to the maximum number of license plates allowed. Any excess use will be billed automatically to your chosen payment method as described in Clause 6.

2.2 By registering, you authorize us to bill you for any excess use associated with your registered license plates. Please note that once a license plate is stored in the portal, any parking activity exceeding your rented quota will be automatically charged to your saved payment method.

2.3 Please be aware that for license plates stored in our system, payment at the parking facility's pay stations is not possible.

3. Activation for Usage Billing

3.1 Upon registration, you must add and verify a valid payment method. Once registered, you can enter up to the maximum number of license plates allowed. Parking usage will be billed automatically to your chosen payment method as described in Clause 6.

3.2 By registering, you authorize us to bill you for all parking events associated with your registered license plates. Please note that once a license plate is stored in the portal, all parking activity for that vehicle will be automatically charged to your saved payment method.

3.3 Please note that you cannot pay at any pay stations located in the parking facility for license plates you have saved in your account.

4. Fixed-Price Tickets

4.1 Any fixed-price tickets shown in the Business Parking Portal are not legally binding offers, but rather an invitation for you to submit a binding offer to enter into a contract (an invitatio ad offerendum).

4.2 You submit a binding purchase offer by selecting a fixed-price ticket and clicking the "Order with obligation to pay" button. This offer remains binding for fourteen days from the time of booking. We reserve the right to reject your offer at any time before it is accepted.

4.3 A contract is only formed once you receive our declaration of acceptance. Immediately after you place your booking, we will send a confirmation (payment receipt) to the email address you provided in the Business Parking Portal or during the payment process. This confirmation serves as proof of your booking and fulfills our legal obligations under the Austrian E-Commerce Act (ECG), while also acting as our formal acceptance of the contract.

4.4 Once your payment has been received, we will send a confirmation email to the address you provided in the Business Parking Portal or the one we have on file for you. Please note that we cannot send fixed-price tickets by post.

4.5 Unless otherwise specified in the Business Parking Portal, you are not entitled to a specific parking space. Your purchase simply grants you authorization to use the parking facility for the duration of your fixed-price ticket for the license plate number you have registered.

5. Obligations of the Customer

5.1 You are responsible for ensuring that these GTC are followed, including by any administrator you appoint.

5.2 Please be aware that entering your license plate number correctly is essential for verifying your authorization and billing your parking sessions properly. You agree to indemnify us against any third-party claims or damages resulting from an incorrectly entered license plate. You can update or remove license plate numbers yourself via the Business Parking Portal, though please note that plates associated with an active parking session cannot be changed.

5.3 Our booking process is automated and relies on email communication. You must provide a valid email address when setting up your account and ensure that your spam filters or other technical settings do not block our emails.

5.4 You must keep your account credentials and password secure and not share them with anyone, except for the administrator and users they designate. You are responsible for ensuring that paid services are only used by your authorized administrator and users.

5.5 Please notify us immediately if you suspect or become aware that an unauthorized person has accessed your password or account.

6. Prices, Payment Terms and Refunds

6.1 All prices in the Business Parking Portal are gross prices and include the statutory Austrian VAT.

6.2 Fees for excess use are calculated based on the rates valid at the time of the parking event, as shown in the Business Parking Portal. These fees are charged once the parking event ends and are collected monthly in arrears using your stored payment method. By using this service, you consent to this collection process.

6.3 Fees for permanent parking spaces are billed in advance and collected via your stored payment method. By using this service, you consent to this collection process.

7. Liability

7.1 We are only liable for damages in cases of intent or gross negligence. In cases of slight negligence, our liability is limited exclusively to personal injury.

7.2 We are not liable for indirect damages, loss of profit, loss of interest, unrealized savings, consequential damages, financial losses, third-party claims, or the loss of data and programs and their restoration.

7.3 In all other cases, the Operator is only liable—unless otherwise stated in Clause 7.4—for breaches of contractual obligations that are essential for the proper execution of the contract and on which the Customer can typically rely (so-called cardinal obligations). In such cases, liability is limited to foreseeable and typical damages. This limitation of liability also applies to our vicarious agents. Otherwise, liability is excluded, subject to the provisions in Clause 7.4.

7.4 The Operator's liability for damages resulting from injury to life, body, or health, as well as liability under the Austrian Product Liability Act (Produkthaftungsgesetz), remains unaffected by the above limitations and exclusions.

8. Data Protection

Information regarding data protection can be found by the Customer at https://www.mh-parkservice.com/at/datenschutz/.

9. Copyright

The Operator owns the copyright to the images, films, and texts on the Business Parking Portal or holds the usage rights for third-party content. Any use of these images, films, or texts by third parties requires prior approval from the Operator.

10. Place of Jurisdiction, Applicable Law, and Contract Language

10.1 These GTC and the resulting contract are governed exclusively by the laws of the Republic of Austria, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The contract language is German.

10.2 For all legal disputes arising from or in connection with these GTC and contracts concluded under them—including questions regarding their validity, performance, and pre- or post-contractual effects—the courts in Gmunden shall have exclusive jurisdiction.

10.3 If one or more provisions of these GTC are or become invalid, void, or incomplete, the validity of the remaining provisions shall remain unaffected. The parties agree to replace any invalid or void provision with a valid one that most closely reflects the original intent and purpose of the parties.

11. Code of Conduct

The Operator has not subscribed to any specific codes of conduct as defined by Section 9 (2) of the Austrian E-Commerce Act (ECG).
