Last updated: 25.08.2026

Mobility Hub Parkservice Switzerland GmbH, based in Stans (CHE-202.380.105), hereinafter referred to as the “Operator”, provides parking space management services for parking lots or parking garages (hereinafter each referred to as a “Parking Area”) using a barrier-free digital parking management solution based on automated license plate recognition upon entry and exit from the parking area.

The following General Terms and Conditions of Business and Use (“GTC”) apply in their version valid at the respective time exclusively to the use of the Business Parking Portal accessible at business.mh-parkservice.com (hereinafter: “Business Parking Portal”) of the Operator, and to the distribution and billing of parking services via the Business Parking Portal.

The Operator recommends that you print or save these GTC and other legal and contractual texts for the documentation of the respective transaction.

The Operator does not store the full text of the contract for each individual transaction.

1. Scope of application, definitions, user account, and contact options:

1.1 Only commercial tenants, i.e., natural or legal persons who provide services as part of a professional or commercial activity, are entitled to use the Business Parking Portal and are considered a “Customer” within the meaning of these GTC.

1.2 These GTC apply (a) to the use of the Business Parking Portal by the Customer or by the administrator appointed by the Customer as the central authorized contact person for the Business Parking Portal (“Administrator”) and (b) to all contracts concluded by the Customer with the Operator regarding the parking services presented in the Business Parking Portal or in these GTC. Parking services within the meaning of these GTC are understood to be all products and services that can be booked with the Operator via the Business Parking Portal or are provided by the Operator in accordance with these GTC.

1.3 The inclusion of the Customer's own terms and conditions is hereby rejected, unless otherwise expressly agreed in writing with the Customer.

1.4 In accordance with the description in the Business Parking Portal, the Operator enables the Customer to:

  • i) Manage fixed parking space quotas: The Customer can enter and manage license plates authorized for automatic recognition and eligibility verification for parking spaces or parking space quotas rented from the Operator or their landlord. The maximum number of license plates that can be entered is specified in the Business Parking Portal.
  • ii) Utilize additional parking spaces and manage over-usage: Upon payment of an over-usage fee based on the valid tariff stored in the Business Parking Portal at the time, the Customer is entitled to have more parking spaces used on the parking area by license plates registered as authorized than were rented by the Customer (“Over-usage”). The license plate recognition system installed on the parking area automatically detects when over-usage occurs and calculates an over-usage fee in accordance with Section 6.2.
  • iii) Purchase fixed-price tickets: To the extent provided for in the Business Parking Portal, the Customer may purchase fixed-price tickets for the parking area for a pre-determined parking duration (e.g., long-term parking tickets (weekly, monthly, and annual passes)) for the parking area specified in the Business Parking Portal, in accordance with the description in the Business Parking Portal.

1.5 Active use of the Business Parking Portal requires registration and the creation of a user account in the Business Parking Portal. For this purpose, the Customer will receive an invitation email from their landlord or the Operator. To register and create the user account, the Administrator must provide at least the following information for the Customer: company name, administrator name, email, street and house number, postal code, city. Providing a payment method is mandatory for registration and creation of the user account.

1.6 To confirm the registration, the Administrator will receive an activation link sent to the email address provided, which they must click to complete the registration for the Customer (a so-called “double opt-in procedure”).

1.7 All information provided by the Customer must be truthful. If data provided during registration changes, the Customer is obliged to correct it immediately in the respective user account via the settings in the Business Parking Portal. The Customer must always ensure that the payment method provided has sufficient funds. If the Customer fails to comply with these obligations, the Operator is entitled to invoice the resulting additional expenses and costs (e.g., for address inquiries, returned direct debits, etc.).

1.8 You can contact the Operator by mail at Mobility Hub Parkservice Switzerland GmbH, Obere Spichermatt 12, 6370 Stans, Tel.: +4121 5613630, info@mh-parkservice.ch.

2. Activation for the billing of over-usage

2.1 When registering the user account, the Customer must provide and verify a valid payment method in the billing details. Upon completion of registration, the Customer can enter a maximum number of authorized license plates as specified in the Business Parking Portal. Cashless billing and payment for over-usage will subsequently take place automatically via the Customer's user account and the chosen payment method in accordance with Section 6.

2.2 By completing the registration, the Customer authorizes the Operator to bill for all over-usage carried out with the license plates provided. The Customer is aware that when license plates are stored in the Business Parking Portal, all usage processes on the parking area carried out by vehicles with the license plates provided that exceed the number of parking spaces rented by the Customer will be billed via the payment method provided.

2.3 The Customer is advised that payment at any parking machine that may be present on the parking area is not possible for license plates registered by them.

3. Activation for billing of usage

3.1 When registering a user account, the customer must provide and verify a valid payment method in the billing details. Upon completing registration, the customer may enter up to the maximum number of authorized license plates specified in the Business Parking Portal. Cashless billing and payment for parking usage will subsequently be processed automatically via the customer's user account and chosen payment method, in accordance with Section 6.

3.2 By completing registration, the customer authorizes the operator to bill for all parking sessions carried out with the license plates they have provided. The customer acknowledges that once license plates are registered in the Business Parking Portal, all parking sessions on the premises involving vehicles with those license plates will be charged to the payment method on file.

3.3 The customer is advised that it is not possible to pay at any parking machines that may be located on the premises for license plates registered in their account.

4. Fixed-price tickets

4.1 If the operator offers fixed-price tickets in the Business Parking Portal, this does not constitute a legally binding offer to enter into a contract, but rather an invitation for the customer to submit a binding contractual offer.

4.2 The customer submits a legally binding purchase offer by selecting a fixed-price ticket and clicking the "Order with obligation to pay" button. The customer is bound by this purchase offer for fourteen days from the time of booking. The operator reserves the right to reject the customer's purchase offer until it has been accepted.

4.3 The contract is only concluded once the operator sends a declaration of acceptance. Immediately after the customer completes the booking, the operator will send a booking confirmation (payment receipt) to the email address provided by the customer in the Business Parking Portal or during the payment process. This booking confirmation serves both as documentation of the booking and fulfillment of the operator's legal obligations (Art. 3 para. 1 lit. s UWG), as well as the operator's acceptance of the contract.

4.4 Once the invoice amount has been credited to the operator, the customer will receive a confirmation email at the address provided in the Business Parking Portal or stored in their customer profile. Fixed-price tickets cannot be sent by post.

4.5 Unless otherwise stated in the Business Parking Portal, the customer is not entitled to a specific parking space. The customer merely receives authorization to use the parking area for the duration of the fixed-price ticket with a license plate registered as authorized.

5. Customer obligations:

5.1 The customer is responsible for compliance with these General Terms and Conditions, including by any administrator they appoint.

5.2 The customer acknowledges that providing correct license plate information is essential for proper authorization checks and billing of parking sessions. The customer shall indemnify the operator against all third-party claims and any damages resulting from the customer entering an incorrect license plate. The customer can deactivate or change license plates independently via the Business Parking Portal. However, license plates are locked while a parking session is active.

5.3 Booking processing and communication generally take place via email as part of an automated system. Therefore, when setting up the user account, the customer must provide a valid email address capable of receiving emails sent by the operator. In particular, it is the customer's responsibility to ensure that the receipt of emails from the operator is not blocked by spam filters or similar technical measures.

5.4 The customer shall not disclose the user account, password, or other access credentials to any third party, nor share them, with the exception of the administrator and designated users. The customer must ensure that paid services are used via the user account exclusively by the administrator and authorized users.

5.5 The customer agrees to notify the operator immediately if they become aware of, or have reason to suspect, that an unauthorized third party has gained access to the user account password, or that a password or user account is being used without authorization.

6. Prices, payment terms, and refunds:

6.1 The prices stated in the operator's Business Parking Portal are gross prices, i.e., they include statutory VAT.

6.2 When billing for excess usage, the fee owed for the respective parking session is based on the prices valid at that time, which were disclosed to the customer via the Business Parking Portal. The excess usage fee is charged upon completion of the parking session and collected monthly in arrears via the customer's registered payment method. The customer hereby consents to this debit.

6.3 Fixed-term parking spaces are invoiced to the customer in advance and collected via the customer's registered payment method. The customer hereby consents to this debit.

7. Liability:

7.1 The Operator is only liable to the Customer for damages or compensation for wasted expenditure in cases of intent or gross negligence, in accordance with statutory provisions, regardless of whether the claim is based on contract or tort. In all other cases, the Operator's liability is excluded, subject to Section 7.2. In particular, parking and walking on the parking premises are at the user's own risk, and the Operator is not liable for parking damage or items left in the vehicle.

7.2 The Operator's liability for damages resulting from injury to life, limb, or health remains unaffected.

8. Data Protection

Information regarding data protection can be viewed by the Customer at https://www.mh-parkservice.com/ch/datenschutz/.

9. Copyright:

The Operator holds the copyright to all images, videos, and texts on the Business Parking Portal, or possesses the rights to use such content provided by third parties. Any use of these images, videos, or texts by third parties requires prior approval from the Operator.

10. Place of Jurisdiction, Applicable Law, and Severability Clause:

10.1 The contract governed by these GTC is subject exclusively to substantive Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. The contract language is German.

10.2 The exclusive place of jurisdiction for all disputes arising directly or indirectly from these GTC is the registered office of the Operator.

10.3 Should one or more provisions of these GTC be or become invalid or void, or contain a loophole, the validity of the remaining provisions shall remain unaffected. The parties agree to replace the invalid or void provision with a valid regulation that comes as close as possible to the intended purpose of the original provision.

General Terms and Conditions of Business and Use of Mobility Hub Parkservice Switzerland GmbH for the Use of the Business Parking Portal and the Procurement of Business Parking Services

Version: 25 August 2026

Mobility Hub Parkservice Switzerland GmbH, with its registered office in Stans, Switzerland (CHE-202.380.105), hereinafter referred to as the "Operator", provides parking management services for parking lots and parking garages (each hereinafter a "Parking Facility") by means of a barrier-free digital parking management solution based on automated license plate recognition upon entry to and exit from the Parking Facility.

The following General Terms and Conditions of Business and Use ("GTC"), in the version valid at the relevant time, apply exclusively to the use of the Operator's Business Parking Portal accessible at business.mh-parkservice.com (hereinafter: the "Business Parking Portal") and to the sale and billing of parking services via the Business Parking Portal.

The Operator recommends that these GTC and the other legal and contractual texts documenting the respective transaction be printed out or saved independently. The Operator does not comprehensively store the contractual texts relating to the respective transaction.

1. Scope of Application, Definitions, User Account and Contact Options

1.1 Only commercial tenants are entitled to use the Business Parking Portal and qualify as a "Customer" within the meaning of these GTC, i.e. natural or legal persons who provide services in the course of a professional or commercial activity.

1.2 These GTC apply (a) to the use of the Business Parking Portal by the Customer or by the administrator appointed by the Customer as the central contact person authorized to represent the Customer in respect of the Business Parking Portal (the "Administrator"), and (b) to all contracts concluded by the Customer with the Operator concerning the parking services presented in the Business Parking Portal or in these GTC. Parking services within the meaning of these GTC are all products and services that can be booked from the Operator via the Business Parking Portal or that are provided by the Operator in accordance with these GTC.

1.3 We do not accept any of the Customer's own terms and conditions unless we have explicitly agreed to them in writing.

1.4 As described in the Business Parking Portal, the Operator allows the Customer to:

(i) manage fixed parking space quotas: The Customer can add and manage license plate numbers authorized for automatic recognition and verification for parking spaces or quotas rented from the Operator or the Customer's landlord. The Business Parking Portal specifies the maximum number of license plates that can be added.

(ii) use additional parking spaces and manage excess usage: By paying an excess usage fee based on the current tariff in the Business Parking Portal, the Customer can allow vehicles with registered license plates to occupy more spaces in the Parking Facility than they have rented ("Excess Use"). The facility's license plate recognition system automatically detects Excess Use and calculates the fee according to Clause 6.2.

(iii) purchase fixed-price tickets: If available in the Business Parking Portal, the Customer can purchase fixed-price tickets for the Parking Facility for a set duration (e.g., weekly, monthly, or annual passes) as described in the portal.

1.5 To use the Business Parking Portal, you must register and create a user account. You will receive an invitation email from your landlord or the Operator. To set up the account, the Administrator must provide the following details on behalf of the Customer: company name, Administrator's name, email address, street, house number, postal code, and city. A payment method must be saved to complete the registration.

1.6 To confirm your registration, the Administrator will receive an activation link via email, which must be clicked to finalize the process (the "double opt-in" procedure).

1.7 All information provided must be accurate. If any registration details change, the Customer must update them immediately in the Business Parking Portal settings. The Customer is responsible for ensuring their saved payment method always has sufficient funds. If these obligations are not met, the Operator may charge the Customer for any resulting extra costs (e.g., address inquiries or returned direct debits).

1.8 You can contact the Operator by mail at Mobility Hub Parkservice Switzerland GmbH, Obere Spichermatt 12, 6370 Stans, Switzerland, by phone at +4121 5613630, or via email at info@mh-parkservice.ch.

Excess Use will be billed and paid automatically via the Customer's account and chosen payment method, as per Clause 6.

2.2 By registering, the Customer authorizes the Operator to bill all Excess Use associated with their registered license plates. The Customer understands that once license plates are saved in the Business Parking Portal, any usage of the Parking Facility by these vehicles that exceeds the Customer's rented parking spaces will be charged to the saved payment method.

2.3 Please note that for license plates saved in the portal, payment at any on-site pay stations is not possible.

3. Activation for Usage Billing

4.1 Any fixed-price tickets offered in the Business Parking Portal are not legally binding offers, but rather an invitation for the Customer to submit a binding purchase offer.

4.2 The Customer submits a binding purchase offer by selecting a ticket and clicking the "Order with obligation to pay" button. This offer remains binding for fourteen days from the date of submission. The Operator reserves the right to reject the offer at any time before accepting it.

4.3 The contract is only concluded once the Customer receives the Operator's declaration of acceptance. Immediately after the Customer makes a booking, the Operator will send a booking confirmation (payment receipt) to the email address provided by the Customer in the Business Parking Portal or at the time of payment. This confirmation serves as documentation of the booking, fulfills the Operator's statutory obligations (Article 3, paragraph 1, letter s of the Swiss Federal Act against Unfair Competition (UWG)), and constitutes the Operator's acceptance of the contract.

4.4 Once the invoice amount has been credited to the Operator, the Customer will receive a confirmation email following a successful booking. This will be sent to the address provided in the Business Parking Portal or the one already on file with the Operator. Fixed-price tickets cannot be sent by post.

4.5 Unless otherwise specified in the Business Parking Portal, the Customer is not entitled to a specific parking space. The Customer is simply granted authorization to use the parking facility for the duration of the fixed-price ticket for a vehicle with a license plate number registered by the Customer.

5. Customer Obligations

5.1 The Customer is responsible for ensuring compliance with these GTC, including by any Administrator they appoint.

5.2 The Customer understands that entering license plate numbers correctly is essential for verifying authorization and billing parking sessions properly. The Customer agrees to indemnify the Operator against any third-party claims or damages resulting from the Customer entering an incorrect license plate number. While the Customer can independently deactivate or change license plate numbers via the Business Parking Portal, numbers associated with active parking sessions are locked.

5.3 Booking and communication are handled automatically via email. When creating a user account, the Customer must provide a valid email address capable of receiving messages from the Operator. It is the Customer's responsibility to ensure that these emails are not blocked by spam filters or other technical measures.

5.4 The Customer must not share their user account, password, or other access credentials with third parties, except for the Administrator and users designated by the Administrator. The Customer must ensure that paid services are used through the account only by the Administrator and authorized users.

5.5 The Customer agrees to notify the Operator immediately if they suspect or become aware that an unauthorized third party has gained access to their password or that their account is being used without permission.

6. Prices, Payment Terms, and Refunds

6.1 Prices shown in the Operator's Business Parking Portal are gross prices, meaning they include statutory value-added tax.

6.2 Fees for excess use are calculated based on the prices in effect at the time, as displayed in the Business Parking Portal. These fees are charged once the parking session ends and are collected monthly in arrears using the payment method saved by the Customer. The Customer hereby consents to this collection process.

6.3 Fees for permanently rented parking spaces are invoiced in advance and collected using the payment method saved by the Customer. The Customer hereby consents to this collection process.

7. Liability

7.1 The Operator is only liable to the Customer for damages or reimbursement of wasted expenses in cases of intent or gross negligence, in accordance with statutory provisions. All other liability is excluded, subject to Clause 7.2. Specifically, users park and walk through the facilities at their own risk; the Operator is not liable for damage to vehicles or items left inside them.

10. Governing Law, Jurisdiction, and Severability

10.1 These T&Cs are governed exclusively by substantive Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The contract language is German.

10.2 The exclusive place of jurisdiction for any disputes arising directly or indirectly from these T&Cs is the Operator's registered office.

10.3 If any provision of these T&Cs is found to be invalid, void, or unenforceable, the remaining provisions will continue to be fully effective. The parties agree to replace any such invalid or void provision with a valid one that most closely reflects the original intent and purpose of the parties.
